Zur Anwendung zwingenden Gemeinschaftsrechts in der aktuellen Rechtsprechung des BVerwG zum Artenschutz nach der “Kleinen Novelle” des Bundesnaturschutzgesetzes

Zusammenfassung  Nachdem die “Kleine Novelle” des Bundesnaturschutzgesetzes für Unsicherheit bei der Anwendung der neuen Reglungen gesorgt hat, enthalten die ersten Entscheidungen der h?chstrichterlichen Rechtsprechung eine hohe aktuelle Brisanz. Der Beitrag geht auf die aktuelle Rechtsprechung des BVerwG zum Artenschutz bei Infrastrukturvorhaben unter dem Aspekt des Gemeinschaftsrechts ein. Behandelt werden die Einschr?nkung des St?rungsverbots, “vorgezogene Ausgleichsma?nahmen”, die Prüfung des Ausnahmetatbestands nach vollendeten Tatsachen, die Zulassung von Ausnahmen bei ungünstigem Erhaltungszustand der Art, das Auseinanderfallen von Entscheidungs- und Beurteilungszeitpunkt sowie die Berücksichtigung von Kosten bei Alternativen.     

Optimization and initial evaluation of 1,2-indandione as a reagent for fingerprint detection

1,2-Indandione has been used to develop fluorescent fingerprints on porous materials such as paper. The compound reacts with amino acid residues to produce highly fluorescent fingerprint ridges. An optimized formulation and treatment protocol for using the reagent is presented here. The reagent is applied as a solution in HFE7100 containing acetic acid and ethyl acetate. Treated articles are heated at 100 degrees C for 10 min at ambient humidity and stored in the dark before recording the fingerprints using fluorescence photography or digital imaging. Photodecomposition of the fluorescent fingerprints has been observed. Storage in the dark reduces degradation, extending the lifetime of the fingerprints. Other chemical methods to stabilize the fingerprints proved unsuccessful. Comparisons of the performance of 1,2-indandione with DFO in CFC113 performed on a limited range of substrates indicated that the reagent might be an effective method for the development of latent fingerprints despite the new reagent producing less intense fluorescence.     

The evaluation of methods for soil analysis under simulated scenes of crime conditions

Five simulated scenes of crime have been studied in which the soils adhering to shoes, car tyres and plant roots have been compared with multiple control samples using dry colour, ashed colour, pH, saccharide levels and particle size analysis. Colour and pH were found to be as reproducible under simulated scenes of crime conditions as for true duplicates from homogeneous soil, whereas the variation in saccharide levels was slightly greater than for true duplicates. The interpretational scheme developed for the silt and sand fractions of homogeneous soils was applied to the samples from each simulated scene of crime and every comparison was found to be similar at the 99% confidence limit.     

British Steel And Government Since Privatization: Policy 'Framing' and the Transformation of Policy Networks

Privatization has its own distinctive dynamics, resulting particularly from the institutional restructuring which tends to transform policy networks and communities. This happens principally for two reasons. Firstly, the crucial balance of resource dependencies is changed irrevocably, and established policy communities break down. Secondly, the separation between the principal actors tends to produce a 're-framing' of major policy issues. Here, Schön and Rein's (1994) concept of issue 'framing' offers a useful metaphor for how actors give a coherent organization to a complex reality by selecting for attention a few salient features. At the same time, they argue also that the nature of 'objective' reality might be found in the world's tendency to resist our interpretations, leading to a discovery of the limitations of particular frames. The case of British Steel offers a good example of the dynamics of this process. In the days of state ownership, the British Steel Corporation and government generally shared similar 'frames' on major issues. Since privatization, however, the two actors have tended to adopt separate 'frames' and have become more independent of each other. Multi-arena politics, such as Europeanization, can drive them still further apart. Nevertheless, in recent years British Steel has come to appreciate some of the limitations of its own frame, and has sought to reconstruct its relationship with government. There is an imbalance in the resource dependencies, however, which precludes the reconstruction of a policy community     

An economic analysis of the use of citations in the law

This paper examines the use of citations analysis as an empiricaltool for understanding aspects of the legal system and for improvingthe performance of the system. Emphasis is laid on the use ofsuch analysis as a means to evaluate courts and judges (andtherefore as a judicial-management tool), to test hypothesesabout judicial behavior, and to evaluate and improve legal scholarship.It is argued that economic models, particularly of reputationand of human capital, can frame and guide the use of citationsanalysis in law.
