论民事执行的检察监督

在我国民事执行实践中,"执行难","执行乱"的现象较为突出.要切实维护当事人和案外人的合法权益,维护法院的司法权威,维护国家法制的尊严,应当赋予检察机关对民事执行活动的监督权,明确规定民事执行检察监督的范围和方式.     

朝鲜半岛和平协定与和平机制

2007年以来东北亚局势的重大变化,使签定取代1953年朝鲜半岛《停战协定》的《和平协定》时机日渐成熟。签定新协定的主体应是朝、韩、美、中四方。达成新协定的主要障碍在于实现持久和平的途径,尤其是美国的立场与政策。只有从"停战机制"转向签订《和平协定》,建立和平机制,东北亚地区的和平与稳定才能得到保障。     

成就辉煌的中非互利合作五十年

50多年来的中非关系硕果累累。新中国成立以来,中非在政治上坚持相互尊重、相互支持、互不干涉内政、平等互信;经济上促进互利双赢,基础不断得到巩固;在教育、卫生、文化等社会事业上加强交流,谋求各自文明的发展;在国际事务上,紧密配合,建立了中非新型战略伙伴关系。2000年启动的“中非合作论坛”,在中国与非洲国家建立了一种集体对话机制。而2006年11月4日中非合作论坛北京峰会既是中非50年友好关系的见证,也预示着中非关系的美好未来。

Expert testimony about eyewitness identification

Recent research concerning eyewitness identification is surveyed with respect to its adequacy (reliability and validity) to support expert testimony. The conclusion is that the scientific basis is generally inadequate and that the more we have learned about various aspects of eyewitness identification, the most inadequate it appears. The argument is made that presentation in policy settings requires greater circumspection than would be required in presentation to scientific audiences. Prudential rules are suggested. They would have the effect of sharply reducing participation in the adversarial system.     

Self-reported offending,maturational reform,and the Easterlin hypothesis

The maturational reform hypothesis and the Easterlin cohort size hypothesis are used to specify models in which age, period, and cohort effects on self-reported crime and delinquency are estimated. Curvilinear effects, logarithmic transformations, and the distinction between prevalence and frequency of offending are considered. The maturational reform hypothesis is supported for general delinquency but not for serious (Index) delinquency, for which there appears to be a steady decline in the behavior with age. The Easterlin hypothesis is supported for both general and Index delinquency. Theoretical, methodological, and substantive implications of the results are discussed.
