供需分析与模式选择:将NGO导入社会保障体系

非政府组织(NGO)的导入有助于我国社会保障体系的完善。在实践中,政府与NGO有三种互补性合作模式:政府支持—NGO运作模式、政府委托—NGO经营模式和政府购买—NGO提供模式。在现阶段,确立这些模式并合理、充分地发挥它们的作用,必须培养相应的组织载体,建立健全完善的运作机制。

地震灾害对人类的生存条件造成巨大破坏,同时增加了产生越轨行为的可能性。受灾时特殊社会环境的影响,地震灾害中的越轨行为在时间、空间分布上,越轨行为的类型和方式等方面都有其自身特点。地震灾害中的社会控制主要分为内在控制和外在控制,积极采取这两方面的控制对策有助于减少地震灾害中越轨行为的发生。     

Use of laser microdissection greatly improves the recovery of DNA from sperm on microscope slides

Traditionally, sperms are isolated from vaginal cell mixtures by preferential extraction methods. Although these methods work well when there is a reasonable amount of DNA present, they are problematic when there are limited amounts (ca. 250 pg). In particular, the analysis of sperm from microscope slides has proven difficult. Here, we describe the use of laser capture microdissection (LM) for the isolation of spermatozoa from microscope slides containing sperms and vaginal cells. Such slides are frequently an important source of evidential material during the forensic investigation of rape and other sexual assaults. Low copy number (LCN) PCR was used to compare profiles of sperm DNA prepared using LM and preferential lysis. LM was found to outperform preferential lysis in 15 out of 16 samples. The application of LM to the processing of actual casework slides, and in particular the potential use of LM for the analysis of old cases, is discussed. Finally, 77 post-coital slides were processed in order to accurately assess the robustness of the technique. There was a significant association between the quality of the male profile recovered and time since intercourse that was independent of the number of sperms analysed, suggesting that the DNA was degraded even though the spermhead was intact.     

An investigation into the applicability of the Ward and Siegert Pathways Model of child sexual abuse with Internet offenders

Abstract

This study examined the applicability of the Ward and Siegert (Psychology, Crime & Law, 8, 319–351, 2002) Pathways Model of Sexual Offending to a sample of Internet offenders. The Pathways Model identifies five etiological pathways, each with primary psychological deficits that interact to create a vulnerability to sexual offending behavior. The applicability of this model was tested on a sample of 72 cases drawn from a community sample in England and Wales, via the analysis of primary and associated psychometric indicators of pathway membership. Sixty per cent of men in the sample were found to display dysfunctional psychological mechanisms (43 cases). Two pathways were found to be particularly prominent: the intimacy deficits pathway and the emotional dysregulation pathway. The implications for future treatment and the appropriateness of current treatment programs for this population are examined in the light of these findings.

不当解雇之复职救济制度的反思与完善

按照我国劳动合同立法的原则,用人单位违法解除或终止劳动合同的,劳动者要求继续履行的,复职应当是法定优先选择的救济方式,但在实践中复职救济的施行却异常困难。本文从劳动合同的继续性、人身性以及解雇之形成效力出发,分析复职救济法律适用困难之原因所在,并以限制解雇之形成效力为突破口,尝试提出在特定情形下的不当解雇允许劳动者申请民诉之行为保全,以延阻解雇行为之效力,完善不当解雇情形下复职救济之法律适用。     

非物质文化遗产保护与知识产权制度的兼容与互动

非物质文化遗产是人们在认识自然和改造自然中所形成的文化与社会实践方面的信息及利益,其客体具有无形性的特点.尽管非物质文化遗产的具体内涵在其表征上与传统的知识产权客体存在较大的差异,但从知识产权视角看来,在宏观框架下寻求知识产权制度的保护并非不可逾越.实际上,非物质文化遗产的保护机制与知识产权制度存在一定程度的兼容性,可以通过对现行知识产权制度予以适当变革实现对非物质遗产的法律保护,从而促进我国非物质文化遗产的传承和创新.
