Education programs for divorcing and separating parents are a valuable vehicle for providing to parents the awareness, knowledge, and skills that can lead to a smoother transition and healthier outcomes for their children. Attention to safety concerns in referral guidelines, administrative protocols, and curriculum content is integral to the efficacious and responsible delivery of parent education. In common law, trespassers could not sue for injuries. In the early 1870s, however, courts exempted child trespassers injured by industrial machinery from this rule. The development of the hotly contested “attractive nuisance” doctrine illustrates turn‐of‐the‐twentieth‐century debates about how to allocate the risk of injury from industrial accidents, which linked responsibility to the capacity to understand danger and to exert self‐control. Although at first courts in attractive nuisance cases perceived children as innocent, irrational “butterflies,” they gradually reconceived child plaintiffs to be rational, risk‐bearing individuals, a change reflected and accelerated by the Safety First campaign launched by railroad corporations. This reframing of children's ability to bear risk created the standard of the “reasonable child,” which transferred responsibility for industrial accidents to children themselves. Although by the 1930s the attractive nuisance doctrine had been widely accepted, in practice the “reasonable child” standard posed a difficult hurdle for child plaintiffs to overcome.  相似文献

As the formal powers of the European Parliament have increased with successive treaty changes, its committees' administrations have seen a parallel growth. We argue that such administrative capacity is necessary but not sufficient for acting on formal treaty powers. Administrative capacity has to be combined with political capacity in order to muster policy impact in European Union decision‐making. By differentiating between intra‐institutional administrative and inter‐institutional political capacity, we offer a fine‐grained conceptualization of policy capacity while broadening the theoretical and empirical understanding of the European Parliament's administration as an organizational structure of formal and informal working practices, intra‐institutional coordination and inter‐institutional relations. Based on expert interviews, document analysis and participant observation, the case of the Transatlantic Trade and Investment Partnership illustrates how societal politicization of a specific policy issue triggered the European Parliament to exploit the latent potential of its post‐Lisbon administrative capacity by transforming it into a more readily deployable political capacity.  相似文献

Abstract

The essay investigates the survival strategies of foreign-funded Russian non-governmental organisations (NGOs) in the face of the so-called ‘foreign agents’ law of 2012. Conceptualising NGOs as autonomous social systems and drawing on two qualitative case studies of Russian NGOs in the fields of human rights protection, we show how these organisations manage to cope with the state’s withdrawal of legitimacy by creatively handling their diverse environmental dependencies. Through shifting the relative importance of different audiences and generating new sources of legitimacy, they have eventually created and maintained small supportive ecologies within the overall environment of a political regime that does not tolerate them.  相似文献
