The current study attempts to address a key, but underdeveloped, area in crime reporting literature: the decisions of non-victims to report crime. Drawing on a theory of criminal justice decision-making, we argue that the decision to report a crime reflects a rational process, where the individual considers his or her goals, potential actions, and the relative ability of those actions to achieve the specified goals. Differences in each of these areas result in different decision-making processes for victims and third parties. We offer a preliminary test of our arguments using data from the National Crime Victimization Survey. In general, we find support for our expectations, with third party reporting decisions more heavily influenced by crime seriousness and less so by the offender’s relationship with the victim than are victim reporting decisions. In concluding, we argue that third party reporters should be focal points of future reporting analyses.  相似文献

The authors wished to determine whether depression was present in an early adolescent nonpatient identified school population. Questionnaires were administered to seventh and eighth grade students in a parochial extended elementary school. The findings indicated that 33.3% of this school population were experiencing moderate to severe depression and 35% of the sample acknowledged current suicidal ideation. A comparison of mean scores showed a trend toward more depressive symptomatology in the eighth grade, possibly indicating a developmental critical period. A correlation of individual scores and teacher ratings suggests that teacher evaluation may have some direct effect on the student's emotional health. Much of school bullying involves students policing the gender roles and sexuality of other students. The proliferation of antibullying laws presents an opportunity to formally punish and mark gendered harassment as unacceptable. However, when this form of peer policing involves girls, administrators often consider it to fall outside the purview of the law. We use bracketing theory to understand how middle school administrators in New Jersey assess whether student behavior violates a statewide harassment, intimidation, and bullying law. We find that, according to administrators, violations require relational asymmetry between an aggressor and victim: an imbalance of power and disproportionate participation. Administrators rarely see gendered harassment as bullying because of the relational stereotypes they attach to girl students, which often preclude interpretations of relational asymmetry. We discuss how gender beliefs among administrators and “bracketing failures” explain the ways antibullying laws allow hegemonic beliefs about gender and sexuality to remain untroubled.  相似文献

Child custody evaluations (CCEs) are often seen as a necessity by the legal system when caregivers cannot find a resolution to their child custody disputes. In many instances, these evaluations are quite costly for the litigants and cost can act as a barrier to equal access to justice. Affluent families are better able to access private evaluators while families with lesser means may encounter delays in receiving services or be unable to afford an evaluation at all. This can, in turn, prolong resolution of league disputes, increasing the emotional toll on families, and hamper courts in making decisions in the best interests of the children involved. This article examines models of providing CCEs outside of an isolated individual provider private practice format. It examines the benefits and considerations for lower-cost evaluations, while discussing how to maintain high quality services that adequately assess family systems. Broader issues that impact the courts and overall access to justice through offering cost effective evaluations are also discussed.  相似文献

Abstract

Appearances in cyberspace are deceptive and problematic. Deception in the cyber domain poses an immensely difficult challenge for states to differentiate between espionage activities in cyberspace and cyber attacks. The inability to distinguish between cyber activities places US cyber infrastructure in a perilous position and increases the possibility of a disproportionate or inadequate response to cyber incidents. This paper uses case analysis to examine the characteristics associated with the tools and decisions related to cyber espionage and cyber attacks to develop a framework for distinction leveraging epidemiological models for combating disease.  相似文献

Are the board members of regulatory agencies (regulators), taken as a particular cluster within the public sphere, independent of elected politicians and tenured bureaucrats? How can we assess their independence in practice, beyond formal rules? To address these questions, this paper delves into two key dimensions: board members' social connections and their security of tenure in office. Firstly, we focus on regulators' identity as policy adjudicators and examine their political and administrative relations. In doing so, we expect to understand better how regulators' social and political situations may influence their behavior. Secondly, we assess their political vulnerability through political cycles in order to measure their de facto independence over time. Additionally, variations in these two dimensions are compared with respect to the effect of different de jure appointment rules. We contrast these expectations with the empirical evaluation of board members of regulatory agencies in Spain (1979–2010). Thus, we confirm that regulators who have an administrative profile are more vulnerable to political changes than those with political ties, while appointment rules have an influence on their political vulnerability.  相似文献
