The Presumption of Innocence and its Role in the Criminal Process

Many international instruments proclaim that those who face criminal prosecution ought to be afforded a ‘presumption of innocence’, and the importance and central role of this presumption is recognized by legal systems throughout the world. There is, however, little agreement about its meaning and extent of application. This article considers the purposes of legal presumptions in general and explores various, sometimes contradictory, conceptions of this most famous one. It is equated by many scholars to the requirement that the prosecution prove guilt beyond a reasonable doubt. As such, it is merely a rule of evidence (albeit an important one), with no application pre- or post-trial. The article advocates adoption of a broader, normative approach, namely that the presumption reflects the relationship which ought to exist between citizen and State when a citizen is suspected of breaching the criminal law. As such, it should be promoted as a practical attitude to be adopted by the key protagonists in the justice system, for the duration of the criminal process.

Abstract

The globalization of markets is calling national employment and social legislation increasingly into question, so that not only the international trade union organizations but also the Clinton Administration are calling for workers’ rights to be embodied in trade agreements. This paper deals with both the fundamental question of whether international labor standards serve a useful purpose and the more specific question of whether trade agreements are a suitable way of enforcing minimum standards. It will argue that international standards can plausibly be justified in terms of development theory. Core labor rights, furthermore, enjoy universal acceptance. A social clause can help in enforcing these rights. The procedures for negotiating social clauses and for implementing them as proposed by the international trade union movement do not lend themselves to protectionism.     

The Fulfillment of Parties’ Election Pledges: A Comparative Study on the Impact of Power Sharing

Why are some parties more likely than others to keep the promises they made during previous election campaigns? This study provides the first large‐scale comparative analysis of pledge fulfillment with common definitions. We study the fulfillment of over 20,000 pledges made in 57 election campaigns in 12 countries, and our findings challenge the common view of parties as promise breakers. Many parties that enter government executives are highly likely to fulfill their pledges, and significantly more so than parties that do not enter government executives. We explain variation in the fulfillment of governing parties’ pledges by the extent to which parties share power in government. Parties in single‐party executives, both with and without legislative majorities, have the highest fulfillment rates. Within coalition governments, the likelihood of pledge fulfillment is highest when the party receives the chief executive post and when another governing party made a similar pledge.     

Video Game Violence Use Among “Vulnerable” Populations: The Impact of Violent Games on Delinquency and Bullying Among Children with Clinically Elevated Depression or Attention Deficit Symptoms

The issue of children’s exposure to violent video games has been a source of considerable debate for several decades. Questions persist whether children with pre-existing mental health problems may be influenced adversely by exposure to violent games, even if other children are not. We explored this issue with 377 children (62 % female, mixed ethnicity, mean age = 12.93) displaying clinically elevated attention deficit or depressive symptoms on the Pediatric Symptom Checklist. Results from our study found no evidence for increased bullying or delinquent behaviors among youth with clinically elevated mental health symptoms who also played violent video games. Our results did not support the hypothesis that children with elevated mental health symptoms constitute a “vulnerable” population for video game violence effects. Implications and suggestions for further research are provided.     

Concurrent and Prospective Analyses of Peer, Television and Social Media Influences on Body Dissatisfaction, Eating Disorder Symptoms and Life Satisfaction in Adolescent Girls

The degree to which media contributes to body dissatisfaction, life satisfaction and eating disorder symptoms in teenage girls continues to be debated. The current study examines television, social media and peer competition influences on body dissatisfaction, eating disorder symptoms and life satisfaction in a sample of 237 mostly Hispanic girls. 101 of these girls were reassessed in a later 6-month follow-up. Neither television exposure to thin ideal media nor social media predicted negative outcomes either concurrently nor prospectively with the exception of a small concurrent correlation between social media use and life satisfaction. Social media use was found to contribute to later peer competition in prospective analysis, however, suggesting potential indirect but not direct effects on body related outcomes. Peer competition proved to be a moderate strong predictor of negative outcomes both concurrently and prospectively. It is concluded that the negative influences of social comparison are focused on peers rather than television or social media exposure.
