The aim of this case report is to describe two cases of sexual abuse by elderly subjects for which the Judge commissioned an expert psychiatric-forensic opinion. The elderly are generally believed to commit nonviolent crimes, whereas the two cases we observed feature forcible rape committed by elderly offenders, who showed no form of mental disease and had rationally planned their offense. They had never previously committed similar acts and had no history of homosexuality; both had been married for many years before the death of their wives and had adult children. Finally, no previous episodes of rape emerged in their personal histories during interrogations. The sociocultural context in which the crimes were committed was identical and arouses interest as regards both the method employed and how the crimes were discovered. The legal authorities then commissioned accurate investigations including medicolegal and psychiatric-forensic evaluations of the offenders and their victims.  相似文献

Dental forensic identifications based on comparison of antemortem and postmortem radiographs provide effective and reliable evidence. There are no standardized procedures for assessing similarities between different types of dental radiographs (e.g. orthopantomograms, bitewings, and periapical radiographs), and the operator's subjective judgment can considerably affect identification. The purpose of this study is to evaluate the potential influence of experts' qualifications, training, and cognitive bias on the accuracy of identification. Seventy-eight differently qualified and experienced experts underwent an identification test. The expert sample was composed of 10 specialists in emergency care (ER), 10 specialists in legal medicine (ML), 20 pregraduate dental students (STU), 12 dentists (DENT), 20 dentists educated in forensic odontology (DENT-TRA), and 6 experienced forensic odontologists (FOR). The simulated cases required participants to assess the possible matching of 42 postmortem intraoral radiographs with 16 antemortem panoramic radiographs. Accuracy and specificity for the different operator groups were as follows: ER, 0.76-0.70; ML, 0.76-0.88; STU, 0.89-0.82; DENT, 0.87-0.97; DENT-TRA, 0.88-0.92; and FOR, 0.97-1. As evidenced by high rates of accuracy and repeatability, the most experienced forensic odontologist consistently outperformed operators less or differently educated and trained, especially for difficult cases. In our sample, the dentists who received additional education in forensic odontology did not necessarily perform better than dentists who had not received this additional education. Some cognitive bias, mainly the so-called observer effect, emerged as a possible source of outcome variability among the operator groups.  相似文献

Tests of the relationship between budget rules and fiscal performance are metric sensitive and arbitrary in the evaluation of the stringency of the rules, in the aggregation of these evaluations in an index and in the imposition of a linearly specified model. We propose a nonlinear principal component analysis to solve these problems and evaluate the relative disciplinary power of each rule. A battery of panel regressions on 1980–2003 optimally transformed data relative to 12 EU countries confirms that, upon controlling for standard economic, political and institutional variables, more stringent rules reduce fiscal imbalances and budget size.  相似文献

Regulatory agencies responsible for preventing misuse of public funds do not all operate in the same fashion. Some carefully weigh the costs and benefits associated with various enforcement policies, but others do not. We use game theory to suggest that (1) regulatory agencies actually have a range of enforcement options at their disposal and (2) these enforcement options can have quite different cost-benefit ratios, depending on the resources of the enforcement agency, the nature of its connection to principals, and the strategies adopted by opportunistic actors. We conclude that enforcement organizations must be flexible in order to be effective.  相似文献

Silvio Berlusconi poses a problem for the existing literature on prime ministers and their power. Though Italian prime ministers are traditionally seen as weak, Berlusconi has been able to achieve some remarkable policy gains during his current term as prime minister. This article uses veto player theory and combines it with existing institutional and political explanations for variation in prime ministerial power to look at this challenging case. By looking at the number of veto players in the Italian system, and their ability to credibly use their veto against Berlusconi, an explanation is posited which can accommodate the exceptionalism of his second term in office. Despite the emphasis on his control of the media, we conclude that Berlusconi's power stems from more traditional political factors. The authors argue that Berlusconi's coalition and party allies have no choice but to accept his will and his decisions, as any alternatives are less appealing.  相似文献

We describe the investigation of the 1999 collapse of an apartment building in Foggia, Italy. Sixty-one victims were recovered in the rubble of the building, and five people were unaccounted for. All the bodies were well preserved except for two who had been burned. The majority of the victims were identified visually or by comparing body features, clothing, or personal effects with information collected from relatives or friends. Positive identifications of the two victims who were burned were obtained by dental comparison and DNA analysis. Approximately half of the victims (51.6%) sustained fatal injuires, while the remainder died from asphyxia. The injuries were characterized using the Abbreviated Injury Scale (AIS) and the New Injury Severity Score (NISS) systems. Injury severity associated with the location of victims inside the apartment may provide useful information for those involved in building design and/or search and rescue operations. Engineers determined that the collapse was the result of the use of inappropriate foundation material.  相似文献

This article examines the criterion of comparative causationaccording to which an accident loss is apportioned between afaultless tortfeasor and an innocent victim on the basis oftheir relative causal contributions to the loss. To explainthe rule's structural features, we consider a scenario whereliability is allocated on the basis of causation, regardlessof fault. While this model brings to light several interestingfeatures, it also unveils the limits of such a criterion withrespect to induced activity and care levels. Next we extendthe model to consider the comparative causation rule in conjunctionwith negligence rules. Applying the comparative causation ruleunder a negligence regime induces a combination of incentivesthat is not provided by any known liability rule.  相似文献

Preceded by a string of institutional crises and sustained political wrangling, the Northern Ireland Assembly election held in May 2016 cemented the grip of the Democratic Unionist Party and Sinn Féin over the province’s power-sharing institutions, while certifying the impasse of their intra-bloc rivals. Eighteen years after the Good Friday Agreement, the electoral campaign continued to feature emotionally charged ethnic appeals. Nonetheless, socioeconomic issues were at the fore of the political debate, contributing to the limited yet significant advance of non-sectarian actors. Beneath the surface of a mainly unaltered Assembly makeup and unchanged ethno-political geography, the vote resulted in a decline in support for the traditional governing parties, particularly in the nationalist camp. In the aftermath of the vote, the formation of an officially recognized Opposition has opened uncharted political waters.  相似文献

Violence perpetrated by organized crime nowadays represents a major threat to state stability, both because it directly challenges political institutions, targeting officials and using terrorist techniques, and because severe inter-group conflict strongly affects human security. Though it is a distinctive feature of illegal markets and a constant strategy of Mafia-like groups, the occurrence of violence is localized in time and space. The article aims to explain temporal and spatial variation in Mafia killings focusing on its political determinants, as organized crime is deeply embedded in the political system. The analysis shows that there is a clear link between the structure of the political markets and the severity of violence. In particular, the fragmentation of the political market is negatively associated with the strategy of criminal groups to exploit violence. By contrast, single-party dominance and bipartisanship lead to an increase in homicides since these organizations have few opportunities to access the political arena. Outcomes are assessed through the analysis of monthly homicides reported by police forces in Italian provinces from 1983 to 2008.  相似文献
