Reviewing the Election Court's decision that a candidate's parliamentary election literature was unlawful under the Representation of the People Act, the Divisional Court held that statements could either be about a candidate's public character or his personal character but not both. Though the legislation was compatible with the ECHR if it penalised only the latter, the question for the courts is really a matter of whether statement impugns a candidate's character more than merely as a necessary implication of an allegation regarding conduct such as the breaking of election promises. 相似文献

This paper examines race-based peremptory challenges. Such challenges occur during the voir dire jury selection process. The process allows both the defense and the prosecution to strike jurors who they believe will not
decide cases fairly. However, in the case of Batson v. Kentucky 476 U.S. 79 (1986), the Supreme Court ruled that race could not be used as a factor in eliminating prospective jurors. This
paper examines federal litigation for five years in which it was alleged that race was used as a factor in removing a juror.
An examination of the cases revealed that most of the cases involved sole male litigants who allege that there were multiple
race-based peremptory challenges used in their cases. Moreover, most of the cases that led to the allegations involved violent
offenses. Other case characteristics are noted, but of most significance was the finding that most appellants lost their cases.
As such, the courts felt that most of the challenges were, in fact, race neutral. The implications of this research are discussed.

This paper is based on a study of apprenticeship, a long renowned institution for transferring technical know-how. Case studies
of apprenticeship led us to define know-how as: a commercially viable integration of proficient technique gained by practicing
the work process of an expert and contextual knowledge gained by observing and questioning other workers. One implication
of this definition is its stress on know-how transfer teams that consist of work process designers, practice tutors, and transfer
manager. A second implication calls for explicit planning of know-how adaptation when new technology makes work processes
obsolete. A final implication for researchers in technology transfer stresses the integration of individual know-how into
