The end of police prosecutions: Symptom of changing values in english criminal justice

This article contrasts the traditional English prosecutorial system, and its underlying values, with the new Crown Prosecution Service and the related values which have emerged from five years of official study and planning of prosecutorial reform. The traditional system reflected the English ideal of the amateur generalist. Under this system the police, acting as citizens, undertook most prosecutions, hiring legal assistance as needed. Ower the last twenty years, about three-quarters of the English police forces set up prosecuting solicitors departments. While these institutions give professional legal assistance to many police, they were purely local arrangements without statutory basis and legally similar to the traditional ad hoc arrangements. In 1986 the Crown Prosecution Service will be initiated. This is the product of a process of development which includes a Royal Commission, two governmental working parties, a white paper, a bill, and a managerial study. The result is a hierarchical structure of legal professionals independent of the police who will handle virtually all prosecutions. This prosecutorial structure exhibits the characteristics and values of modern rationalistic bureaucracy described by Max Weber. The adoption of these values in English criminal justice indicates the likelihood of change in other aspects of the system which rest on the conflicting traditional values.     

The Strategic Uses of Gender in Household Negotiations: Women Workers on Mexico's Northern Border

The study illustrates the potential of the 'doing gender' perspective to explain why employment does not always improve women's household–power. Eighteen in–depth interviews with women maquiladora workers in Mexico suggest that, depending on the gendered meanings of household negotiations, employment may help women gain new rights and extend the limits of respect accorded them by male companions and parents. Nevertheless, women were more successful when they used negotiating strategies that conformed to their gender identity, such as making offers , than when they used negotiating strategies that challenged traditional gender norms, such as withdrawing services or making threats .     

Can epidemiological studies assist in the evaluation of community treatment orders? — The experience of Western Australia and Nova Scotia

Epidemiological studies using administrative databases have several advantages over other methodologies in studying the effectiveness of compulsory community treatment such as community treatment orders (CTOs). We compared patients placed on CTOs in Western Australia with controls drawn from both within the jurisdiction and from another without this measure (Nova Scotia). Although in different countries, the mental health services in both jurisdictions share common characteristics. Notably, we were able to control for forensic history in our comparison within Western Australia. We analysed predictors of admission and number of bed-days using multiple, logistic or Cox regression as appropriate. Of the 274 subjects placed on a CTO, we were able to find controls for up to 96% (n = 265). CTO placement was not associated with reduced admissions or mean bed-days, although there was a threshold effect with a reduced risk of inpatient stays exceeding 100 days. Outpatient contacts were significantly greater for the CTO group. However, we do not know whether the intensity of treatment, or its compulsory nature, effected outcome.
