The article highlights the challenge before the courts to the decision of the parliamentary select committee to remove the former Chief Justice of Sri Lanka in January 2013. Parliament and the President proceeded with the impeachment and removal of the Chief Justice, despite court decisions, on the basis that this was a power specifically granted to the parliament under the constitution. The article examines how the legitimacy of impeachment proceedings of superior court judges can be ensured within the concept of the separation of powers without adversely impacting on the independence of the judiciary and the rule of law. 相似文献

Concepts and skills from the Public Administration field are in strong demand by local governments in Slovakia and in the Czech Republic. After forty years in which local level initiatives in government and in business were squelched, there now exist extensive opportunities. After discussing the extent of past centralization, population trends and local public spending by city sizes are defined for the Czech Republic. A comparative analysis of a single Czech city with a German city of similar size points out some special limitations in land use employment and tax base facing local public policy makes. This commentary points to the poor state of empirical measures of the quality of states, that is, executive branches and their bureaucracies. Much of the problem is conceptual, as there is very little agreement on what constitutes high‐quality government. The commentary suggests four approaches: (1) procedural measures, such as the Weberian criteria of bureaucratic modernity; (2) capacity measures, which include both resources and degree of professionalization; (3) output measures; and (4) measures of bureaucratic autonomy. It rejects output measures and suggests a two‐dimensional framework of using capacity and autonomy as a measure of executive branch quality. This paper reports on a study of 227 children and young people, all living in a West Midlands city in the UK, who between November 1993 and December 1999 were accused of having sexually abused a child. The study had two main objectives: first to examine the alleged behaviours, family backgrounds and personal characteristics of the young people; and second to discover what factors, if any, may be associated with recidivism later in adulthood. It is still too early to draw firm conclusions regarding recidivism, because half of the sample has not yet reached adulthood. In this article I examine the legitimacy of direct action in relation to liberal deliberative norms and global institutions (World Bank, World Trade Organization, etc.). Because the deliberative processes of these institutions are illegitimate according to the theory of deliberative politics, the activists of the movement for global justice are legitimate to confront these institutions. Moreover, confrontational action in itself may have a deliberative value for at least seven reasons: (1) initiating deliberation (agenda-setting); (2) enlarging participation; (3) enlarging representation; (4) disseminating information and arguments (publicity); (5) stimulating imagination; (6) pushing for action; (7) re-opening deliberations. Finally, social movements such as the movement for global justice may be seen themselves as deliberative arenas. Thus, those who seek to evaluate the legitimacy of direct actions need to take into consideration the deliberative nature of the process through which activists decide which means may be more efficient in order to repair defects in the official deliberative process, and promote equality, liberty, and justice. 相似文献
