Bernard Crick's contribution to citizenship studies can be regarded as part of the tradition so ably represented by T.H. Marshall. I want to argue in this brief article on Crick that on the one hand he is part of the ‘golden age’ of political philosophy that has flourished in the English-speaking world over the last two or three decades, but on the other his work also shows the limitations of that tradition, at least from the perspective of comparative and historical studies in political sociology. His work was unquestionably ‘local’ in its focus on the subject of Scottish independence and the viability of the British Isles under the governance of a multi-national state.  相似文献

It is understandable that Iran’s December 2006 hosting of an international conference casting doubts on the historicity of the Holocaust would raise questions about treatments of the Shoah elsewhere in the Third World. In fact, indigenization the Holocaust—the manifold ways in which serious scholars, activists, and writers from Asia, Africa, and Latin America have come to incorporate the Holocaust in their intellectual work—has been positive overall. Within the framework of intellectual globalization, much of the Third World intelligentsia has come to include this most Western of human rights violations within the framework of their own cultures and histories. Although some of the indigenization of the Holocaust is political and instrumental, the deviant variant expressed at the Tehran Holocaust conference is atypical. Governmental respect for the memory of victims of genocide should be considered as an emerging human right.  相似文献

The social welfare effects of legislatures in presidential systems, such as the U.S. Congress, are frequently lamented. In response, there are proposals to reform the separation of powers system by giving presidents control of the legislative agenda and weakening rules such as the filibuster. We provide a game-theoretic analysis of the policy and social welfare consequences of a more executive-centric system. Integrating standard assumptions about legislative and executive incentives into a dynamic model of decision making with private investment, we show there are a variety of conditions under which stronger executives do not produce better outcomes. Moreover, we characterize how these conditions depend on factors such as the stability of the policymaking environment or investment fundamentals. Our findings are robust and consistent with empirical observations that U.S. policy outputs are not necessarily worse than those of nations with stronger executives, which more closely approximate prominent proposals by populist-oriented reformers.  相似文献

The rate of expansion and the breadth of COVID-19 caught the world by surprise. From the perspective of nonprofit and public entities responsible for service provision, this pandemic is also unprecedented. The authors offer a RISE framework for navigating the fiscal effects of COVID-19 and rely on recent surveys to assess the response strategies of local governments and nonprofit organizations. They find that many nonprofits were hit fastest and hardest by the pandemic and that local governments are, essentially, trying to figure out their financial condition moving into the next budget cycle.  相似文献

Circuit splits, or conflicting rules across multiple U.S. Courts of Appeals, have important policy implications and dramatic effects on Supreme Court case selection, yet we know little about the incentives ideological lower courts face when deciding whether to initiate conflict. This article develops a formal model of a judicial hierarchy where lower court judges are subject to review by a high court with distaste for unresolved conflict, termed “split-intolerance,” and with uncertain preferences over policy. Lower courts may compete by investing costly effort in legal quality to make their rules more attractive. In equilibrium, lower courts may initiate conflict even when the odds of success before the high court are remote. Surprisingly, lower courts grow more likely to create conflict as the high court's split-intolerance increases; however, split-intolerance can also incentivize greater lower court effort. I present qualitative evidence illustrating the model's explanatory power.  相似文献

There are growing concerns about how algorithms are being used and whether they are accountable. This article reviews the literature on the issue of algorithms in several key areas, such as fairness, accountability, and transparency. In many types of social situations, individuals defend their claims to a portion of the rewards by arguing that they are just. Although a great deal of research demonstrates that individuals differ in their distribution preferences and thus their beliefs about what is fair, the literature curiously omits consideration of the consequences of these differences, especially the conflict they may engender. This paper first reviews the few attempts to address such justice conflict. The limitations of these approaches suggest concerns to be addressed in an alternative framework. The paper presents a theoretical discussion of this alternative that integrates assumptions about distribution preferences, justice beliefs, conditions fostering the emergence of justice conflict, and elements of negotiation processes as a basic framework for predictions about the bargaining strategies individuals may employ to resolve competing justice claims.  相似文献

The necessity of rapid objective appraisal of the suspicion of intracorporeal drug smuggling (body-packing) by effective methods of investigation in the course of the first criminal investigation department measures raises the questions of suitable and admissible methods. The proportion of undetected crimes in intracorporeal narcotic smuggling must be rated as very high according to the data of the Federal Criminal Investigation Department. In the present paper, the suitability of various imaging techniques for drug detection are reported in terms of their risk, practicability and costs. For this purpose, the value of digital radiography, two-spectra radiography and X-ray computer tomography as compared to conventional X-ray investigations is examined in human experiments. A reality-oriented narcotics dummy (glucose pressed hard in preservative) was developed and administered to nine volunteers per os with a variable initial alimentary situation. Four radiograms were taken at fixed times up to 12 hours after administration with each imaging technique. The highest rate of detection was attained with computer tomography. In contrast to the other methods, more than 90% of the body packs could be identified here. Nevertheless, an application in criminal investigation practice cannot be recommended owing to various disadvantages. The recovery rate of the remaining methods is between 20% and 25%.  相似文献
