我国基础教育事业单位改革最新进展及评析

改革开放以来,随着我国事业单位改革的整体推进,教育事业单位改革也不断走向深入,有力地推动了我国教育事业的发展。文章对近年来我国中央和地方政府在基础教育事业单位领域,围绕现代学校制度建设、人事制度改革等进行的一系列改革举措进行了较为全面的梳理,剖析了改革取得的成就,并重点分析了各地改革实践中存在的普遍性问题,以期为深化我国教育事业单位改革提供一定借鉴。     

The building of the democratic tradition in South Africa's trade unions after 1973

This article traces the emergence of the democratic union tradition in the trade union movement that emerged in the wake of the 1973 strikes in South Africa. Contrary to the conventional wisdom that attributes the emergence of this tradition solely to a generation of young white union activists and labour-supporting intellectuals, the article argues that this tradition owes its origins to a multiplicity of sources. The article emphasises the social character of trade unions and how they bear the imprint of the historical and cultural heritage and social experiences of their members and leading activists. Thus the article challenges the notion that a social group enters into new associational forms as a tabula rasa. Instead, it claims that the building of the democratic union tradition in South Africa is not just an outcome of intellectual influences but significantly was shaped by the workers' ‘lived experiences’.     

循环经济发展中的公众参与:问题与思考

循环经济的发展离不开公众的参与。但是,我国公众在参与意识和参与理念上与循环经济发展的要求仍有很大差距;在参与主体上相对单一,民间环保组织参与不足;在参与内容上过于狭窄,公众参与权有限;在参与方式和参与途径上亦难以有效满足公众参与的要求。因此,亟需加强对公众参与意识和环境保护理念的培养和教育,促进民间环保组织的发展并充分发挥其在公众参与中的积极作用,扩大公众参与的权利,并不断拓展公众参与的方式与途径。     

国有企业承担社会责任的政府规制研究

国有企业在承担社会责任的过程中,常常会出现企业自身利益与社会整体利益之间的矛盾。企业承担社会责任的意愿不足、资源配置不合理等现象极其普遍,这主要是因为在没有良好的制度规制的前提下,国有企业承担社会责任的行为会出现偏差。本文认为,政府应构建一个制度平台,对国有企业的行为进行相应的规制,以促进国有企业社会责任的承担和落实。     

Competitive analysis,structure and strategy in politics: a critical approach

• This article begins by arguing that the structure of the political market differs significantly from business markets and that, consequently, the prescribed strategies from ‘traditional’ marketing theory are not always appropriate in politics.
• Then the military metaphor is applied to the political market and its ability to illuminate competitive strategy in this market is explored. Particular attention is paid to the interaction of direct and indirect strategies in politics over the lifecycle of a parliament.
• The relevance of military principles in implementing the strategies identified is then considered. The paper concludes with a wider discussion of the limitations of the military/competitive model as applied to politics and a general indication of how a more comprehensive competitive model might be created.

Randi W. v. Muroc Joint Unified School District 1997: implications for employer liability in employment references

The California Supreme Court in the case entitled Randi W. v. Muroc Joint Unified School District 1997 ruled that employers may be liable for negligently and intentionally misrepresenting an employee's suitability in their employment references. The case concerned a 13‐year‐old girl student who was allegedly molested by a school vice‐principal, Robert Gadams, in his office. Gadams had been the subject of charges of sexual impropriety involving female students in his three previous teaching posts. The plaintiff sued Gadams, and a range of defendants who had written references recommending him for employment. The Court found that the defendants could be held liable for fraud and misrepresentation because the facts allegedly known about Gadams were not disclosed in the references. The article examines the consequences of the ruling for the provision of employment references. In particular, it examines the ‘no comment’ option, whereby employers only confirm basic employment details about employees.

本文分析了新公共服务理论因其超越了传统公共行政的效率中心论和新公共管理的市场化和企业化模式等工具性价值的内在矛盾和缺陷,突显了民主、公民权和公共利益等目的性价值在现代公共行政的中心地位,由此使其在人性、公共道德责任、公共道德目的、公共道德准则、公共美德等方面发挥积极作用,产生重大影响,具有重要的伦理价值,为现代公共行政的合法性奠定新的公共道德基础。
