More than 50 years after the end of the Nuremberg Tribunal, the Berlin Mauerschiitzenprozesse, a series of trials in the Nuremberg tradition, devoted to bringing to justice former GDR soldiers and officials involved in the application of deadly force against Republikfluchtlinge on the inner German borders, have reached their crescendo. More than 50 soldiers and officials have received sentences of up to six years’ imprisonment. Among the many issues at hand, none are more important than that of nullum crimen sine lege, or the Rückwirkungsverbot. Is the process of trying and punishing former GDR soldiers and officials legally justifiable under Article 103, section 2 of the Grundgesetz? Or are the Mauerschützenprozesse a classic example of ‘victors ‘justice?’ Using the Nuremberg Tribunal as a foundation, this article will argue that the Mauerschiitzenprozesse are legitimate, and that the sentences imposed against GDR functionaries do not violate the principle of nullum crimen sine lege. 相似文献

Why do laws become similar across countries? Is the adoption of similar laws and policies due to factors operating independently within each country? Do countries develop similar rules in response to similar challenges? Or is the similarity of laws and policies due to the interdependent responses that scholars have referred to as processes of policy convergence, transfer, and diffusion? We draw on an analysis of immigration and nationality laws of 22 countries throughout the Western Hemisphere from 1790 to 2010, and of seven case studies of national and international policymaking, to show that policies are often interdependent, even in the domain of immigration law, which scholars have presumed to be relatively immune to external influence. We argue that specific mechanisms of diffusion explain the rise of racist immigration policies in the Americas, their subsequent decline, and the rise of an anti‐discriminatory norm for policies. Most striking among our findings is that at key junctures after 1940, weaker countries effectively advanced an anti‐discriminatory policy agenda against the desires of world powers. The economic and social gains from electronic commerce (e-commerce) that promote innovation, industry upgrading and economic growth have been widely discussed. China’s successful experience with e-commerce has had a positive effect in transforming consumer-goods sectors of the economy and motivating economic reform. This article looks at how e-commerce reduces barriers to entry and enables firms to move up the value chain by using the global value chain framework to analyse the impact of e-commerce on the upgrading trajectories and governance structures of China’s apparel industry. For large Chinese brands, e-commerce has enabled end-market diversification. For small- and medium-sized enterprises, e-commerce has facilitated entry with functional upgrading as well as end-market upgrading. In the “two-sided markets” created by platform companies, the “engaged consumers” are the demand side of this market, and “e-commerce focused apparel firms” are the supply side of the new market. Abstract: This paper examines trends in local economic development policies in Canadian and US cities over the past fifteen years. Using data drawn from surveys conducted at four points in time ‐ 1990, 1994, 2001, and 2005 ‐ the study provides a longitudinal assessment of change versus stability in overall approach toward economic development. Findings indicate that Canadian and US cities have followed relatively similar trajectories in the extent to which they use particular economic development policies. Overall, the most common economic development policies in both nations have been and continue to be very similar: infrastructure investment generally, land development, basic promotion, and the use of special events to attract and retain businesses and residents and to promote the community. Thus, there is a visible pattern of the “least of differences” among cities in Michigan and Ontario in their development strategies and approaches. Sommaire: Le présent article examine les tendances qui se sont dégagées des politiques de développement économique local dans les villes canadiennes et américaines, au cours des quinze dernières années. À l'aide des données tirées de sondages réalisés à quatre moments différents, à savoir en 1990, 1994, 2001 et 2005, l‘étude fournit une évaluation longitudinale des changements par rapport à la stabilité dans l'approche globale à l’égard du développement économique. Les résultats indiquent que les villes canadiennes et américaines ont suivi des trajectoires relativement similaires dans la mesure où elles ont recours à des politiques de développement économique particulières. As part of a larger study of probation workload and workforce challenges in one southeastern state, this study reports the results from a statewide survey of probation officers’ experiences supervising probationers with mental illness. A total of 615 officers responded to closed- and open-ended questions about the challenges and barriers to supervising offenders with mental illness, and the responses of officers from rural versus urban settings were compared. Officers reported that probationers with mental illness are difficult to supervise and supervision challenges are exacerbated by a scarcity of mental health and substance abuse treatment resources, limited social support, and a lack of employment opportunities for this population of probationers. Officers report unique and similar challenges across rural and urban settings. This study contributes to our understanding of the challenges of supervising probationers with mental illness and informs practice, policy and research at the interface of the criminal justice and mental health systems. 相似文献
