Substituting a judgment of best interests: dignity and the application of objective principles to PVS cases in the U.K

The mêlée that surrounded the last days of Terri Schiavo's life was reminiscent of a classical Greek tragedy. Much like Antigone, Ms. Schiavo became enmeshed in irresistible and opposite forces, resolved to use her situation as an arena for the determination of political and legal issues as diverse as the exercise of states' rights, the extent of individual rights, the role of the judiciary, the re-opening of the abortion debate, and the regulation of stem cell research. As Europeans watched the drama unfold, the forces at play in the United States clashed head-on, in a rhetorically inflammatory spectacle which, on this side of the Atlantic, left many aghast. Most unsettling was the prospect of individuals wielding the power of state and national legislatures in what was, ultimately, an intensely personal affair. In the United Kingdom, the struggle was a stark reminder of the differences, not only between British and American political culture, but between our approaches to legal issues which present themselves at the end of life. The existence of well-established procedures and principles, and the extensive involvement of neutral third parties and the courts in pursuit of an objective determination of an individual patient's 'best interests', are key to the conclusion that Terri Schiavo's case would have been handled at least as effectively and efficiently as it was by the courts in Florida and the United States. That issues of consent and capacity can be determined by British courts on the basis of generally applicable principles leads to the subsequent conclusion that a 'best interests' determination leaves significantly less scope for conflict than the individualistic, much more personal and determinative construct of the 'substituted judgment' test in the United States.     

Intimate Partner Violence Victims’ Accuracy in Assessing their Risk of Re-abuse

Using four categories of accuracy (true positive, false positive, true negative, false negative), this study explored (1) how accurately intimate partner violence (IPV) victims are able to assess their risk of re-abuse; and (2) potential predictors of accuracy. Women seeking help for IPV (N = 246) rated the likelihood that they would experience physical re-abuse in the coming year and then reported 18 months later whether those risks had been realized. Victim assessments were more likely to be right than wrong, and were subject to neither a pessimistic nor optimistic bias. In the multivariate analysis, significant/marginally significant predictors of the accuracy categories were the history of violence from this and former partners, level of substance use, PTSD symptoms, and the recency of the violence. Among the more robust findings were the connection between level of stalking and true positives, and between substance use and false negatives. This study suggests that victim assessments have significant potential to inform practice, and deserve further exploration.

Public Administration Scholarship and the Politics of Coproducing Academic–Practitioner Research

Developing greater cooperation between researchers and practitioners is a long‐standing concern in social science. Academics and practitioners working together to coproduce research offers a number of potential gains for public administration scholarship, but it also raises some dilemmas. The benefits include bringing local knowledge to bear on the field, making better informed policy, and putting research to better use. However, coproduction of research also involves managing ambiguous loyalties, reconciling different interests, and negotiating competing goals. The authors reflect on their experience of coproducing a research project in the United Kingdom and discuss the challenges that coproducers of research confront. They situate the discussion within a consideration of traditions of public administration scholarship and debates about the role of the academy to understand better the politics of their joint practice. Thinking about the politics of coproduction is timely and enables the authors to become more attuned to the benefits and constraints of this mode of research..     

ID‐Check: Online Concealed Information Test Reveals True Identity

The Internet has already changed people's lives considerably and is likely to drastically change forensic research. We developed a web‐based test to reveal concealed autobiographical information. Initial studies identified a number of conditions that affect diagnostic efficiency. By combining these moderators, this study investigated the full potential of the online ID‐check. Participants (n = 101) tried to hide their identity and claimed a false identity in a reaction time‐based Concealed Information Test. Half of the participants were presented with personal details (e.g., first name, last name, birthday), whereas the others only saw irrelevant details. Results showed that participants′ true identity could be detected with high accuracy (AUC = 0.98; overall accuracy: 86–94%). Online memory detection can reliably and validly detect whether someone is hiding their true identity. This suggests that online memory detection might become a valuable tool for forensic applications.
