Order authorizing termination of certain life support systems

An elderly, severely brain-damaged patient was being ventilated and given nutrition and antibiotics intravenously in a medical center's critical care unit. Her legal guardian requested authorization to order that the respirator be withdrawn and the administration of nutrition and antibiotics be stopped. A Missouri circuit court ruled that, while public policy, as evidenced in the state's living will statute, permitted withdrawing the respirator, it apparently precluded withholding or withdrawing nutrition, hydration, or antibiotics.     

法官事实认定面孔融合下的有限能动——以民事庭审为视角

本文以两个案情相似但结果迥异的民事案例为切入点,通过对笔录的分析,勾勒出我国基层法官在民事庭审中对事实认定呈现的两种面孔——回应型和能动型;同时,两位法官均不是纯粹的回应型和能动型面孔,又恰恰反映出当下我国基层法院法官在民事庭审事实认定中出现的两种面孔融合趋势,即法官的有限能动面孔。本文通过访谈方式、运用数据分析、成本分析及价值权衡等研究方法,分析两种面孔之成因并指出其融合之必要性,最后得出完善我国法官释明权制度,确立有限能动庭审面孔的结论。     

Personality typologies of male juvenile offenders using a cluster analysis of the Millon Adolescent Clinical Inventory introduction

The Millon Adolescent Clinical Inventory (MACI) is a unique adolescent instrument that attempts to delineate between personality and acute symptoms. This study sought to explore typologies based on the Personality Pattern scales of the MACI in a sample of detained male juvenile offenders (N = 103). A Ward's method cluster analysis yielded a four-cluster solution, and each cluster was provided a clinically relevant label: (a) disruptive, antisocials; (b) agreeable, antisocials; (c) anxious, prosocials; and (d) reactive, depressives. The largest group consisted of the reactive depressives (n = 41). This suggests the importance of considering the role of internalizing problems as a conduit to delinquency in addition to antisocial personality. No interaction between cluster membership and offense history or race was found.     

Market Demand for Civic Affairs News

This paper uses time series methods to test the relationship between civic affairs content and audience share for the ABC, CBS, and NBC evening news in the mid-1990s. Because these programs competed in the same market, but varied the amount of their civic affairs coverage, they present an excellent opportunity to analyze this relationship. The study uses hand-coded news abstracts and O.J. Simpson murder trial coverage as separate measures of news content. The study finds that lower levels of civic affairs content and higher levels of O.J. news are associated with greater audience share.     

浅谈家庭暴力的救济

家庭暴力是指行为人以殴打、捆绑、残害、强行限制人身自由或其他手段,给其家庭成员的身体、精神等方面造成一定伤害后果的行为,持续性经常性家庭暴力构成虐待。我国立法上对家庭暴力的概念进行了确立,并对其后果进行了定性。然而在实际操作中对家庭暴力救济的现状不尽人意,应建立一套包括自力救济、社会救济、司法救济在内的完整的救济机制,彻底解决家庭暴力问题。
