Water-soaked evidence: detectability of explosive traces after immersion in water

Various factors governing the detectability of explosive traces after being soaked in water were studied. The variables are: the type of the surface (surfaces liable to be found in aircraft were chosen), the type of explosive, the type of water (tap or seawater), and movement of the immersed surface in the water. The maximal immersion times (tmax) after which explosive detection was possible were evaluated. This datum was found to depend on the type of explosive (one of the important factors is solubility in water), the surface material and the environmental conditions (tap or seawater movement). Detection of PETN on high-density polyethylene, linoleum, glass and aluminum, by the chemical Explosive Testing Kit (ETK), was possible even after a month of soaking in seawater. In addition, it has been found that movement of bulk water around the samples with deposited explosives considerably decreases tmax values. It is, therefore, recommended to retrieve samples for explosive analysis as soon as possible and in areas where the currents of water is minimal.     

Judicial discretion and sentencing disparity in adult felony courts in Israel

This study focuses on a series of legal, extralegal, and systemic variables presumed to affect the workings of criminal-justice systems. These variables are employed first to analyze the decision of the court to refer defendants for presentence investigation when such a referral is not mandatory, then to examine how these referrals, once made, influence disposition. The relationship of legal representation to disposition is also explored.The findings contradict conventional wisdom regarding the advantages to defendants of legal representation and of presentence reports. Lawyers do not appear to influence either referral or sentencing. The presentence reports are requested by judges seeking to individualize their sentencing decisions, but this process of individualization is as likely to result in harsher sentences as in greater leniency.

Critique,Use and World in Giorgio Agamben's Genealogy of Government

This article explores the implications of Giorgio Agamben's genealogy of government for our understanding of critique. Agamben argues that the providential government of the world of Christian theology has bequeathed to the West an ontology of will and command. Replacing the pantheistic world of Stoic late Antiquity, the Christian world must be other than it is. The lack that this introduces is central to Agamben's account of nihilism, as it was also for Nietzsche. But what does this mean for critique? Does critique belong to the nihilistic tradition of the West; occupying the still-warm seat of God inasmuch as it finds the world wanting as if from the outside? Does this mean we are left only with affirmation—passively acceding to the world as we find it? Or is this alternative of world-rejection/world-affirmation a false one? Agamben's concept of use seeks a way out of it.     

Symposium,Cannabis—Legal,Ethical, and Compliance Issues: Introduction

This introduction reviews six articles presented at the 2020 symposium, “Legal, Ethical, and Compliance Issues in Emerging Markets: Cannabis in the States.” Scholars from across the United States and Canada presented research using the lens of law and strategy, ethics, and compliance to focus on the U.S. cannabis industry. The articles are discussed within the framework of institutional voids common to emerging markets, which may include a lack of a fully developed regulatory system and issues related to financial markets. These institutional problems create complexity for consumers, producers, municipalities, and state governments in this industry, and make success for this market segment more challenging. The introduction contributes to the discussion by reviewing securities litigation involving the cannabis industry generally and specifically in light of some of the issues identified by authors in the special issue.     

The Israeli criminal justice system in action—Is justice administered differentially?

This study focuses on two major junctures in the Israeli criminal justice system, the preadjudication stage and the trial stage. The data are gathered from records accumulated during the period 1980 through 1992. For each year between 1980 and 1992, a random sample of 3637 persons, who had their first police contact that year, was drawn from the computerized central file at Israeli Police Headquarters. A total of 40,007 individuals, with a total of 97,000 records, constituted the study population. The results identify which criminal records were most likely to be terminated prior to adjudication and which records, once adjudicated, were most likely to conclude in conviction. Major emphasis was placed on the issue of nationality—being an Arab or a Jew—while the effect of other variables, such as the type of offense and the time period, were controlled. The criminal justice system was found to be less discriminating at the early stages of the criminal process, but as the offender moved along the process, the chances that nationality would play an important part increased.
