解析东亚福利模式之谜——父系扩展家庭在儿童保护中的作用

在中国的郴州农村,父系家庭和扩展家庭在孤儿养护中发挥了主导作用,在家庭的范围内分散风险,由家庭和扩展家庭承担福利服务的成本,对家族成员提供照料,并且用极少的代价进行再分配,有效地减少了国家必须的福利支出,同时儿童得到了有效的保护,但是,家庭保护制度本身已经负荷过重。在儿童抚养成本中现金支出日益增加的情况下,农村家庭对孤儿的保护功能日益削弱。由于国家和社区作用缺位,这个群体中的贫困发生率很高。这项研究还发现传统父系扩展家庭在承担了对孤儿进行经济支持的同时,排斥了母亲对儿童的照料。     

论我国执法制度的重理

执法制度的重理是我国改善执法状况、提高执法水平的需要，也是我国加入WT0后政府行为适应调整的需要。根据目前我国执法中存在的问题，我国执法制度的重理主要涉及执法形式重理、执法组织重理、国家公务员管理重理、执法方式重理、执法程序重理等。     

Reflecting on 'Linkage': Cognitive and Institutional Change in The International Trading System

Since the creation of the World Trade Organisation, the international trading system has lived through a decade of sustained and vocal public criticism. International trade lawyers have made significant efforts to engage, evaluate and respond to these critiques. This article assesses the adequacy of these responses, focusing on the so-called 'trade and' debate – or 'trade linkage' debate – in international trade law. While this debate has produced valuable insights, it tends to legitimate and reproduce precisely those aspects of the trade regime which it purports to contest. Drawing on the insights of economic history, an alternative mode of scholarship is proposed – at once historical, critical, constructivist and institutionalist – to augment the current literature in the 'trade and' debate. Concrete lines of enquiry are proposed which, if followed, would help international trade lawyers to respond more productively and with greater legitimacy to contemporary public critiques of the international trading order.     

兔出血症病毒Yaan株衣壳蛋白VP60基因的克隆和序列分析

采用RT-PCR方法扩增兔出血症病毒(RHDV)Yaan株衣壳蛋白VP60基因,将扩增片段克隆到pMD 18-T载体上,经酶切及PCR鉴定后测序。结果显示,VP60基因全长1 740 bp,编码579个氨基酸。将Yaan株与其他RHDV分离株进行比较,结果显示,核苷酸同源性为90.5%~97.5%,氨基酸同源性为94.3%~99.5%,氨基酸变异多发生在衣壳蛋白C、E区,表明毒株具有高度保守性;同时对Yaan株与国外标准株AST/89的VP60蛋白氨基酸变异及其亲水性、柔性区、抗原区和表面结构进行了比较分析。     

Placing the suspect at a PC: A preliminary study involving fingerprints on keyboards and mice

Digital devices now play an important role in the lives of many in society. Whilst they are used predominantly for legitimate purposes, instances of digital crime are witnessed, where determining their usage is important to any criminal investigation. Typically, when determining who has used a digital device, digital forensic analysis is utilised, however, biological trace evidence or fingerprints residing on its surfaces may also be of value. This work provides a preliminary study which examines the potential for fingerprint recovery from computer peripherals, namely keyboards and mice. Our implementation methodology is outlined, and results discussed which indicate that print recovery is possible. Findings are intended to support those operating at-scene in an evidence collection capacity.     

The Taiwanese Economic “Miracle”: Continuing?

The island of Taiwan has successfully managed 60 years of fast-paced economic growth. Taiwan is a demonstrably resilient player in the global economy, while also maintaining high levels of income equality. However, there is a great deal of uncertainty surrounding whether the factors that have enabled and sustained the Taiwanese development project thus far will be an adequate means of managing the contemporary challenges facing the island. Taiwan may be becoming increasingly vulnerable to global economic conditions, and the island’s future seems also to be increasingly tied to developments in the Chinese mainland. This paper examines the prospects for a continuing Taiwanese growth paradigm from both a cultural and an economic perspective and finds reason for optimism. This optimism is contingent on the strength of international export markets and prudent management of cross-Strait relations with the Chinese mainland.     

地理空间预测模型在以情报为导向的警务工作中的应用——以美国新泽西情报运作中心为例

构建地理空间预测模型是指根据犯罪分子有意识或无意识选择的喜好的空间信息,把成百上千个地理空间因素融合在一起,形成统计偏好相似性的地理空间模型。构建地理空间预测模型是以情报为导向的警务工作中所运用的一种新兴工作方法,是一种更为积极主动的预防犯罪的方法。     

监视居住制度评析——以2011年《刑事诉讼法修正案(草案)》为视角

2011年《中华人民共和国刑事诉讼法修正案(草案)》(以下简称《修正案草案》)充分注意到了现行监视居住制度在实施过程中所暴露出的问题,并对监视居住制度进行了一系列的改造。《修正案草案》的立法初衷是将监视居住确立为一种减少羁押的替代性措施,但具体的条文设计却使监视居住制度产生了内部的分裂。在嫌疑人、被告人自己住所执行的监视居住可以被认为是一种非羁押性的强制措施,但指定居所的监视居住显然已成为一种羁押性的强制措施。因此,为了防止权力的滥用和充分保障嫌疑人、被告人的人权,对指定居所的监视居住需要进行更为严格的审查与控制。具体的审查、控制方法可以参照对逮捕的审查、控制方法,同时也需要确立对其进行定期羁押必要性审查的制度。另外还需确立错误指定居所监视居住的国家赔偿制度作为最后一道"防线"。
