论行政命令的出罪功能

我国刑法中,行政命令作为犯罪构成要件要素存在是不争的事实。该部分犯罪的认定不仅要结合刑法的规定,还要参见行政法的相关规定或行政机关的行政决定。行政命令出罪功能的考察不仅要从形式上进行,还要从实质上考量。基于此,拒绝执行行政命令不能免除行政相对人的刑事责任;公务人员明知上级命令明显违法而执行的,也不能免除刑事责任;违法的行政规章在特定条件下可以免除执行者的刑事责任;司法机关不能在判决书中直接否定抽象行政命令的法律效力。

The contemporary world situation is undergoing complex and deep changes and at a conjuncture of major transformation and readjustment. Generally speaking, the international situation is stable and the common wish of the people of the world is to seek peace, development and cooperation. The international balance of power is developing in the direction favourable to world peace, leaving little possibility of major scourge of war that may disequilibrate world configuration. But the old problems affecting world tranquillity are still pending with cropping up of new problems and new conflicts. The relations among major world powers are undergoing delicate changes. There is uncertainty in regional conflicts and hot spot issues in the Middle East and Africa. Traditional security threats are intertwined with non-traditional ones.     

电子政务:推进地方政府决策民主化的一个有效途径

本文通过对全国四级地方政府公务员的实证调查,运用统计学分析方法得到结论:电子政务水平与决策民主程度之间的相关性显著.即在实际工作中,电子政务的应用对于决策程序的民主化有着确实的推动作用.数据也显示出电子政务发展中存在的问题,主要是形同虚设、使用率低,没有真正发挥电子政务扩大公众参与和信息公开的作用,只有半数的地方政府部门在决策程序中有效实施公众参与和信息公开.因此,需要进一步提高我国电子政务的使用率,为地方政府的民主决策程序提供一个有效的途径.     

独立董事法律问题研究

In order to avoid independent directors from being against minority shareholders, and urging them to play the role of checking up big shareholders and insiders with full power in listed companies, the rules for independent directors shall be amended gradually. Currently, the reform on the independent director regime shall be made in some aspects. First, the positions of independent directors shall be held by qualified professionals; Second, independent directors shall pass the exam for such posts; Third, independent directors shall take full-time jobs; Fourth, the firms of independent directors shall be established with limited partnership liability; Fifth, independent directors shall undertake joint liabilities. Guan Xiaofeng, professor of School of Civil and Commercial and Economic Laws, China University of Political Science and Law (CUPL). He is also an arbitrator of China International Economic and Trade Arbitration Committee (CIETAC). He has engaged in teaching and research on civil and commercial laws for a long term, and written a monograph of Introduction to Financial Law. Moreover, he has released over 40 academic papers in respect of commercial, financial and contract law.

美国的律师资格考试制度及其借鉴

美国实行的是法律职业一元化制度，律师是领取营业执照、为社会上不特定多数人服务、在社会上执行律师职务的人员，检察官是国家雇佣的政府律师，法官则从多年从业、实务经验丰富、品行良好、得到相应法律职业管理机构推荐的律师中选任。因此，在美国，要想从事法律职业，作律师、当检察官，以至于成为受人尊敬的法官，都必须通过律师资格考试，取得律师资格。
