浅议中国共产党领导的多党合作与政治协商制度的现实意义

产权视野下的民办学校合理回报制度重构

合理回报可对民办学校产权产生重要影响,但是现行法律规范对其规定却存在诸多缺陷,故其在实际运行中困难重重。为保障出资人合理回报权能够得以实现并确保民办学校产权有效扩充,合理回报制度应予重构。     

Improving Public Service Delivery: The Crossroads Between NPM and Traditional Bureaucracy

This article analyses a New Public Management (NPM) style of reform recently introduced in Portuguese public administration. The reform introduces new organizations to a method of delivering public services called 'Citizen Shops' (CS) ( Lojas dos Cidadãos ). Several public services are concentrated in a single building whose management follows the practices of the private sector concerning service delivery and opening times, rather like a 'shopping centre'. 'Citizen Shops' is a kind of agencification and is an attempt to avoid the constraints of civil service red tape and bureaucratic resistance to change. The author argues that the extent to which new ideas were imported from NPM was limited and constrained by the institutional framework and the culture prevailing in Portuguese bureaucracy. Citizen Shops reproduced the hierarchical and centralized nature of service delivery and followed the traditional patterns of control. The prevailing structure is an important constraint on NPM development.     

Quasi-National European Identity and European Democracy

Democracy may well be the primary virtue of political systems. Yet European politics is marked by a democracy deficit that will not disappear spontaneously. While legal and political theory on this issue is dominated by supporters of civic institutionalism and constitutional republicanism, liberal nationalists seem to be split. They justify the civic nationhood of member states, but they shrink away from the idea of a European people. This essay claims that a quasi-national conception of European identity can be conducive to the rise of a democratic political union of Europe. It discusses the mechanisms and rules for Europeanization of the sense of equal dignity and solidarity. This approach to supranational identity is explicitly instrumental and orientated towards the long run. However, the main liberal objections against it can be countered.     

Stability study of the designer drugs "MDA, MDMA and MDEA" in water, serum, whole blood, and urine under various storage temperatures.

A controlled study was undertaken to determine the stability of the designer drugs MDA, MDMA and MDEA in pooled serum, whole blood, water and urine samples over a period of 21 weeks. The concentrations of the individual designer drugs in the various matrices were monitored over time, in the dark at various temperatures (-20, 4 or 20 degrees C), for a low (+/- 6 ng/ml for water, serum and whole blood and +/- 150 ng/ml for urine) and a high concentration level (+/- 550 ng/ml for water, serum and whole blood and +/- 2500 ng/ml for urine). Compound concentrations were measured using a validated HPLC assay with fluorescence detection. Our study demonstrated no significant loss of the designer drugs in water and urine at any of the investigated temperatures for 21 weeks. The same results were observed in serum for up to 17 weeks, and up to 5 weeks in whole blood. After that time, the compounds could no longer be analyzed due to matrix degradation, especially in the low concentration samples that were stored at room temperature. This study demonstrates that the designer drugs, MDA, MDMA and MDEA are stable when stored at -20 degrees C for 21 weeks, even in haemolysed whole blood.     

Y-chromosome haplotypes in Italy: the GEFI collaborative database.

A sample of 1176 males from 10 Italian regions have been typed for DYS19, DYS389-I, DYS389-II, DYS390, DYS391, DYS392, DYS393, and DYS385. Individual haplotype data are available on line. A low degree of variation is present among regions. Use of this database is specifically recommended for forensic applications in Italy.     

关于完善我国共同诉讼制度的一个理论前提——兼谈民事审判方式改革

共同诉讼是各国普遍存在的一种诉讼形式 ,因其在防止裁判矛盾、提高诉讼效率等方面的重要作用而受到重视。但我国的共同诉讼制度却因存在许多问题而阻碍了其功能的有效发挥。为了进一步完善该制度 ,解决审判方式改革中存在的一些深层次问题 ,有必要借鉴国外做法 ,将共同诉讼区分为固有的必要共同诉讼和类似的必要共同诉讼 ,并以此为理论前提重新构筑我国的共同诉讼制度     

2004年：中国宪法学理论研究的主要进展

2004年我国宪法学研究取得了长足的进展。在纪念五四宪法和人民代表大会制度实施五十周年、宣传现行宪法第四次修改等一系列活动中,宪法学者的理论成果逐步为社会和公众所了解,而且宪法学以此为研究平台也取得了丰硕的成果。总结已有研究成果,有助于把握宪法学研究的基本方向,以获得推动宪法学发展的学术基础。     

卓越法律人才培养中法律文书学师资队伍建设的困境与对策

重理论教学而轻实践技能的训练导致法科毕业生职业能力难以满足用人单位选人用人之需和建设社会主义法治国家之需是以往我国法学教育的一大硬伤。因此,摆脱这种困境的关键措施之一是加强实践性教学,使法学教育职业化以训练学生的法律职业能力。这就急需师资队伍的实践化。法律文书学课程既可以综合训练学生的法律思维能力、法律解释能力、法律推理能力、法律论证能力和法律事实探知能力,也可以训练学生的法律文书制作技能,可现在该课程的师资队伍却存在着某些不尽如人意之处,难以满足法学教育职业化的需要,所以,应当采取有力措施加强其师资队伍建设。
