The purpose of this article is to describe ways that legal psychology can be introduced into the undergraduate curriculum. The extent to which undergraduate psychology and law courses are currently a part of the curriculum is described, and a model is proposed for coursework in a Psychology Department that might adequately reflect coverage of the legal area. Informal institutions have grown in relevance for the analysis of new ‘third wave’ democracies. The research strategy receives its impetus from the debate on neo‐institutionalism theory, which offers a productive perspective for structuring the field of analysis. This article explains the distinguishing factors between formal and informal institutions. It addresses five basic types of informal institutions, examines the ways in which they function and discusses their relevance in terms of democracy theory. Each type is characterized by the way in which it enacts its respective means of political influence. The study distinguishes between forms of specific relationship (clientelism), of material exchange (corruption), of violent exertion of influence (putsch threat), of civil resistance (civil disobedience) and of legal practice (custom law), and discusses their relevance to democracy. The central argument maintains that a differentiated study of informal institutions is crucial to addressing this question. The necessary typological differentiation allows us to make an appropriate assessment ‐one that does not manifest itself in a simple clear‐cut choice of affirmative or negative answers. 相似文献

In public–private partnerships (PPPs), the collaboration between public and private actors can be complicated. With partners coming from different institutional backgrounds and with different interests, governing these partnerships is important to ensure the projects' progress. There is, however, little knowledge about the perceptions of professionals regarding the governance of PPPs. This study aims to exlore professionals' viewpoints about governing PPPs, and to explain potential differences using four theoretical governance paradigms. Using Q methodology, the preferences of 119 public and private professionals in Canada, the Netherlands and Denmark are explored. Results show four different viewpoints regarding the governance of PPPs. Experience, country and the public–private distinction seem to influence these viewpoints. Knowledge of these differences can inform efforts to govern PPPs and contribute to more successful partnerships. 相似文献

Does Disclosure of Performance Information Influence Street‐level Bureaucrats’ Enforcement Style? 下载免费PDF全文
Governments use different regulatory instruments to ensure that businesses owners or “inspectees” comply with rules and regulations. One tool that is increasingly applied is disclosing inspectees’ performance information to other stakeholders. Disclosing performance information has consequences for street‐level bureaucrats because it increases the visibility of their day‐to‐day work. Using a survey (n = 507) among Dutch inspectors of the Netherlands Food and Consumer Product Safety Authority, this article shows that the disclosure of performance information has an impact on enforcement style at the street level. Findings show that perceived disclosed performance information positively enhances all three dimensions of street‐level bureaucrats’ enforcement style (legal, facilitation, and accommodation). This effect is strongest for facilitation and accommodation and weakest for the legal style. Perceived resistance by inspectees partly explains this effect. Contrary to expectations, more perceived disclosure does not result in more but in less perceived resistance of inspectees by street‐level bureaucrats. 相似文献

The majority of the world's population resides in low‐ and middle‐income countries, where the problem of sustainable development is among the most pressing public administration challenges. As principal actors within the international development community, transnational nongovernmental organizations (NGOs) play a leading role in piloting a wide variety of development‐focused strategies. During the past decade, many of these transnational NGOs, along with the United Nations, have embraced a rights‐based approach (RBA) to development as an alternative to traditional service delivery. Despite the growing popularity of RBA among NGOs and other development actors, surprisingly little attention has been paid to understanding the significance of RBA for public administration and for public managers—the “other side of the coin.” Drawing on current research in NGO studies and international development, this article describes several varieties of contemporary rights‐based approaches, analyzes their impact on development practices, and examines the intersection of RBA and public administration. 相似文献
