This research addresses the influence of mandate design upon implementation efforts and regulatory styles. Empirical analyses of these relationships are conducted for state-level land-use and development-management mandates enacted by California, Florida, North Carolina, Texas, and Washington. Three key findings provide insights about the role of mandate design in facilitating policy implementation. First, implementation efforts are more easily influenced than regulatory styles. Second, it is more difficult to foster conciliatory regulatory styles than it is to foster more legalistic styles. Third, a high degree of statutory coherence is not a necessary condition for strong implementation efforts. More generally, the findings show that policy designers can enhance implementation efforts and shape regulatory styles by altering key mandate features.  相似文献

Daniel Elazar's typology of political culture is updated forall states for 1980 using religious affiliation data. On average,the political culture indices do not vary much from simitarmeasures constructed for 1906–1936. The effects of politicalculture on state politics and policy are tested in two ways:(1) by calculating partial correlation coefficients for tendependent variables holding four environmental variables constant(affluence, industrialization, fertility, and liberal politicalideology), and (2) by estimating regression equations withintwo categories of political culture (individualistic and traditionalistic)to gauge the indirect or contextual effects of culture. Thepartial correlation analysis yields the expected outcome—moralisticstates have more interparty competition, higher voter turnout,more policy-relevant parties, and more liberal and innovativepolicies; traditionalistic states show the opposite result.The attempt to assess the contextual effects of political cultureproves less satisfactory. No such effects appear for about halfthe dependent variables, and the contextual effects that arefound correspond only in part to expectations.  相似文献

The phenomenon of “black-on-black” violence among the people of Africa has, ever since the advent of modernity/coloniality, been articulated in such a way that it presents victims as perpetrators. Thus, from the Mfecane violence of the “pre-colonial” era to the xenophobic/Afrophobic violence of the “post-colonial” era in Africa, incidents of black-on-black violence have always attracted explanations that cast doubt on the humanity of the black subject, through the colonial strategy of inventing and inverting causation. This colonial strategy entails both mis-presenting the epochal history of coloniality by representing it in terms of rupture instead of continuity, as well as representing the indigenous African subject as inherently violent. I argue in this article that black-on-black violence is a product of coloniality—a racist global power structure that makes incidents of “non-revolutionary violence” among the oppressed black subject inevitable. Thus, I deploy the case of the Mfecane violence of the “pre-colonial” era in southern Africa, and the Afro-phobic attacks on foreign nationals in “post-apartheid” South Africa to unmask the longue durée of coloniality, and its role of manufacturing blackon-black violence among the black people of Africa.  相似文献

Most of the existing literature on share contracts is based explicitly or implicitly on agriculture, a sector in which share contracts are seldom dominant and apparently on the decline. Moreover, since agricultural activities have some rather special characteristics, the purpose of the present article is to analyse contractual choice and especially the choice of share contracts in a sector in which share contracts are dominant, namely fishing. In the process of explaining the dominance of share contracts in fishing, the article also explains (a) some heretofore neglected features of these share contracts, such as the way in which shares are calculated and the treatment of repair and maintenance expenditures, (b) the nature and extent of interlinked transactions, (c) the exceptional cases where share contracts are not used, and (d) the relevance of varying environmental conditions and especially those of poor developing countries to the nature of contracts in fishing, and to the differences therein between agriculture and fishing.  相似文献

ABSTRACT

Academics are becoming increasingly internationally mobile, and yet there is still limited research into the nature, outcomes and limits of academic mobility. This paper examines the biographies of over 700 academics employed within Australian law schools. It identifies legal academics who hold academics qualifications have been employed outside of Australia. Almost a quarter of legal academics in our sample hold a first degree outside of Australia, over a third hold a non-Australian post-graduate degree. While it could be expected that possessing international experience would broaden an academic’s cultural experiences, we also found that the internationally mobile academics have typically studied and worked previously within an elite international law school, and are now employed within an elite Australian law school. In addition, experiences of international mobility are not equally distributed, and male legal academics are significantly more likely to have international experience than female legal academics.  相似文献

This article reviews the growing literature on financial reform in developing countries. We draw both on the theoretical contributions outlining the case for and against liberalisation as well as on the experience of many developing countries with liberalisation. We argue that the existence of market failures in financial markets hampers the liberalisation process and indeed suggests that the simple liberalising strategy envisaged in much of the literature is inappropriate. We argue instead for an alternative strategy which integrates some aspects of liberalisation with the development of appropriate financial institutions designed to serve best the needs of the real economy.  相似文献

In the debate over “maternal indifference” and, more generally, over the ways in which children were viewed and treated in the European past, the care of abandoned children has attracted a good deal of attention. Huge numbers of newborns were consigned to foundling homes in past centuries, and attempts to keep the children alive depended heavily on placing them with rural wetnurses and foster families. In general, scholars have portrayed these foster families as having little concern for the welfare of their charges. One consequence of this view is the presumed instability of foster home arrangements for foundlings. Using archival sources, this article investigates the relationships between foster families and foundlings by examining the lives of babies abandoned at the foundling home in Bologna, Italy over the course of the nineteenth century. The study provides grounds for questioning the received wisdom on the subject of foundling care in nineteenth-century Italy and beyond.  相似文献
