Entrapped on the Web? Applying the Entrapment Defense to Cases Involving Online Sting Operations

Many law enforcement agencies are currently responding to the problem of online crime by establishing proactive investigative units that track criminals on the Internet. Not only do these specialized teams face problems in the area of emerging technology, they are also faced with handling emerging legal issues. The current research examined the issue of the entrapment defense, and how previously established physical realm doctrine could be applied to the investigation of online crimes such as child pornography. Relying on previous case law it would appear that entrapment claims related to online sting operations involve consideration of: a) did the law enforcement officer continuously contact the suspect with the intention of trying to convince the individual to engage in a particular type of behavior, b) how long was the relationship between the undercover officer and the suspect, and c) how much, if any, reluctance to commit the criminal act did the suspect provide evidence of?     

朝鲜的变化与中朝关系--从"传统友好合作关系"到"实利关系"

中国和朝鲜关系自1999年开始恢复,这虽不表示两国已恢复过去的同盟关系,但一定会对朝今后的发展起到积极作用.本文首先介绍中朝关系的变化;然后分析在向朝鲜提供改革模式及理念、经济资源、政治军事援助过程中,中国对朝鲜变化产生的影响;最后得出主要结论,即虽自20世纪90年代后期开始,朝中关系正式进入恢复阶段,但双方关系不再以共享理念和战略目标为基础,而是基于现实利益或战术目标.朝中关系这一新特点将继续制约中国对朝鲜变化过程的影响.此外,文章还针对朝鲜的发展变化,就中韩合作问题提出了若干建议.     

A case study of interpreter-mediated witness statement: police interpreting in South Korea

Interpreters play an important role in police interviewing witnesses from culturally and linguistically diverse backgrounds. In the cases where interpreters lack professional attributes such as interpreting competence and impartiality, it is very likely that the interpreted evidence and statement will not be a faithful reproduction of original utterances. If attention is not paid to possible alterations by interpreters to the original utterances of the witness and duty of care is lacking in the procedure of obtaining statement from witnesses through such interpreters, the official legal record may not be an accurate one. Drawing on the data of a video-recorded interpreter-mediated police interview in South Korea, this paper examines issues arising from the lack of understanding of the role of interpreters, which may have implications for criminal proceedings. The findings indicate that in addition to interpreter training, more efficient police training in the adoption of best practice guidelines in interviewing through interpreters is required.     

衡平法外的受信义务——析董事于新《公司法》下之“忠实义务”

修订后的《中华人民共和国公司法》于2006年1月开始实施,其目的在于给投资者营造更为有利的法治环境,并进一步落实相关法律责任的追究与相关法律执行的透明度。新《公司法》将董事受信忠实的概念第一次引入到中国法中。受信概念源于普通法系中的衡平法系统,但普通法系统与衡平法系统在法学与管辖上并存之双轨制度在中国大陆法系中却不存在。本文将由此探究以单纯书面立法的方式引入衡平法中受信概念的可行性。本文认为,只要在这个概念被转化为一个法律概念前对其作出详尽的定义,受信理论的衡平法特性并不会真正阻碍其转化为我国的法律概念。为对上述观点作出阐释,文章以新《公司法》中禁止董事与公司进行自我交易这一具体规定为参照,结合案例讨论了通过对境外司法实践的借鉴、立法机关衡平法技巧的培养,以及更仔细地考察现行的国内法则,来帮助弥补单单引入一个空洞的受信概念不足的可能性。

Zusammenfassung Seit einem Jahr liegen die thematische Strategie für den Bodenschutz und der Entwurf der Bodenrahmenrichtlinie vor, mit denen die Europ?ische Kommission das europ?ische Umweltrecht komplettieren und einen nachhaltigen Umgang mit den Bodenressourcen erreichen will. Jahrzehnte vorher hatten schon die Welt-Boden-Charta und die Europ?ische Bodencharta eine nachhaltige Bodennutzung gefordert, um der anhaltenden Bodendegradation Einhalt zu gebieten. Vor 15 Jahren hatte die Weltgemeinschaft die Rio-Deklaration über Umwelt und Entwicklung und einen Aktionsplan für diese Deklaration, mit denen nachhaltige Entwicklung, nachhaltige Ressourcennutzung und nachhaltiger Bodenschutz umgesetzt werden sollen, vereinbart. Der Beitrag stellt die Strategie, die Rahmenrichtlinie und den Diskurs zwischen den am Entscheidungsprozess beteiligten Organen und Interessenvertretungen von Landwirtschaft und Industrie, der noch im Gange ist, dar. Auch werden einige Schlüsselthemen der Weiterentwicklung des Bodenschutzes, l?sungsbedürftige theoretische Fragen, die im Hintergrund der Auseinandersetzungen stehen, skizziert.     

The Liberals and Vietnam1

How did the Menzies Governments of the early to mid 1960s arrive at the position of sending Australian troops to Vietnam? During the 1950s, Menzies, and especially his External Affairs Minister Richard Casey, developed an appreciation of the strategic significance of Indochina, but struggled to view the conflict in Vietnam in ways other than through Cold War lenses. By the 1960s too, Britain's capacity to demonstrate a lead for Australia in foreign policy for the region was diminishing with its power, and the Menzies Governments were mindful of the need to support an American preparedness to intervene in Southeast Asia against communist‐led forces. This logic became more compelling in the face of Indonesia's “Confrontation” with Malaysia from 1963. As a result, the Liberals were not reluctant to support US military intervention in the region, in Vietnam.
