Nationwide, law enforcement professionals have endured increasing scrutiny regarding their treatment of custodial suspects and their alleged abridgement of suspects’ Constitutional rights. At the same time, in the interests of community safety, many members of the public fully expect police officers to function efficiently in arresting and facilitating the prosecution of likely perpetrators. These perspectives reflect due-process and crime-control models respectively. Very little is known, however, about how law enforcement professionals actually view the rights of the accused when not acutely immersed in the cross-currents of public opinion. Using an anonymous survey, the current investigation addresses both Miranda rights as well as the European Union’s (EU) much more comprehensive approach to the rights of the accused. In general, this sample of 209 urban police officers favored protections of criminal suspects that went considerably beyond Miranda safeguards. 相似文献

Since 1990, 17 states have passed legislation allowing for the civil commitment of a small number of sex offenders who are deemed at a particularly high risk for reoffense. Despite the very public and controversial nature of these laws, little is known about the individuals who are detained pursuant to them. The current article presents data on 190 civilly committed and detained sexually violent predators in Washington State. These sexual offenders suffer from a variety of mental illnesses. The modal offender is diagnosed with both an Axis I and an Axis II disorder. Despite the widespread use of the drug court model, standardized performance measures for drug courts are not uniformly utilized, and rarely include process measures. To ensure that drug courts are being implemented in the most effective manner, the use of performance measurement tools should be considered for wide scale adoption. Drug court effectiveness is moderated by participant characteristics, and is most effective for individuals with the highest substance use needs. Therefore, having quality clinical screening processes is crucial to ensuring that drug courts are serving the population for which they are effective. This paper examines clinical screening in drug courts, to answer the following 1) what is the current state of screening, 2) what works, and 3) why measurement matters. It also proposes a clinical screening performance measure to improve fidelity and ensure appropriate participant enrollment. This paper explores the struggles of China's party-state to address chronic food safety problems by adopting international best practices of risk-based regulation. Despite formally adopting risk-based approaches for targeting inspections and enforcement in 2002, implementation has been halting and uneven, as we show in the first analysis of risk-based regulation beyond its OECD heartlands. Drawing on policy document analysis and 36 key informant interviews with food business operators and government officials working on food safety regulation at every level of the state, we identify contradictions between official commitments to risk-based inspection and top-down demands for zero tolerance and strict accountability, which leave local inspectors preoccupied with avoiding blame more than reducing safety risks. Our analysis advances recent scholarship on regulatory states of the global South by highlighting how risk-based ideas, instruments, and practices are refracted through the distinctive norms and style of China's reactive regulatory state. 相似文献
