The consideration of ecological safety in judicial practice — also on the ecological safety legislation

Ecological safety has been one of the hot issues of environmental law in recent years. The maintenance of ecological safety has become one of the legislative principles, as exemplified by the revision of the Law of Sand Prevention and Sand Management and the Law against Solid Waste Environmental Pollution, and the relevant rules that will be established. However actual cases will still happen, whether the legislators have made the statutory law or not. While scholars and legislators are debating, the judges have to handle cases and render judgments. Through the analysis of a case, this article will discuss the feasibility for judges to make ecological safety considerations in the judicial process by applying the principle of good faith and will also discuss the legislative issues related to ecological safety.

Using the example of the present casualization of labor the following article demonstrates the ??surplus value?? of a perspective on corporate activities that is enriched by insights gained from the field of the sociology of labor. Beginning with a reconstruction of the state of the art on casualization processes of dependent labor it is shown that there has indeed been an intense discussion about the erosion of the so-called standard employment relationship (Normalarbeitsverh?ltnis) and the advancing casualization of dependent labor. The question regarding the casualization of the corporate activities, however, has hardly been recognized. The article will demonstrate that there actually is an ongoing casualization of corporate activities. Moreover, the vital factors for casualization processes in corporate activities will be elaborated. Subsequent to these points, the text raises the question of the implications of a ??twofold?? casualization of labor and its social mediations. In a final step, the article focuses on the systematic-methodological potential of founding research in a theory of practice.     

Ecological Belief in a Just World

To date, there is considerable evidence that the perception of injustice influences environmental behavior in a positive way. Nevertheless, some people do not take action, even if the injustice seems obvious. Concerning this matter, approaches like the belief in a just world theory or system justification theory provide an explanation. However, so far, there is no scientific research on whether the perception of ecological justice, which is taken for granted, concerning an ecological belief in a just world (EBJW) may lead to differences in people’s environmental behavior. This paper investigates a newly conceived construct of the EBJW, regarding its occurrence as well as its disposition in the context of other constructs. Therefore, a new scale has been developed for the purpose of this study by means of a questionnaire with German citizens (n = 312) examining motives for energy-relevant behavior. The scale analyses confirm the validity of the new scale. Even though the EBJW did not score high in the total sample, possibly due to significant differences between the participants (particularly socio-demographic variables and different group memberships) it can be stated that there is definitely a relationship between the EBJW and justification arguments and, ultimately, a lack of responsibility for energy saving. Regression analyses reveal that the EBJW, together with cognitive and affective appraisals of justice, can explain energy-relevant commitment, such as engagement in behavior that has negative impact on the climate. Based on these findings, it is suggested that the EBJW is measurable and that it seems to warrant further research.     

‘We are Scared to Say No’: Facing Foreign Timber Companies in Sierra Leone's Community Woodlands

In recent years, ‘decentralisation’ has become an increasingly prominent theme in Sub-Saharan African development theory and practice, particularly around woodland management. Although much research has illuminated challenges arising in project design and implementation, ‘external’ threats to decentralised resource management initiatives have received little attention. At the same time, however, there has been a massive increase in foreign, particularly Chinese, corporate investment in the extraction of African resources. This paper examines the importance of the interaction between these two trends to local livelihoods and resource management through a case study of illegal logging by Chinese companies in Sierra Leone.     

A Cross-Country Comparison of Corruption and Public Expenditures: A Panel Data Approach

Corruption is an especially serious problem for all countries, and has damaging effects on sustainable economic growth. Although there is a significant relationship between corruption and public expenditures, the degree and way of this relationship is changed according to countries. The main objective of this article is to analyze the relationship between corruption and the level and composition of public expenditures, using data from 21 countries which are classified as countries in above and below average corruption perception indices. In empirical analysis, panel data were used in modeling of the effects of corruption on public expenditures. The empirical results show the findings support the hypothesis that the composition of public expenditures has an important element on corruption for countries.
