当事人更换理论浅论

当事人理论是民事诉讼的三大理论基石之一。在当事人制度的诸多问题当中,非正当当事人及其更换理论在诉讼法学理论界是一个颇有争论的问题。本文从介绍非正当当事人及其更换理论入手,分析我国非正当当事人更换理论的现状,并针对这一现状进行分析,重构我国的当事人更换理论。     

Polymorphism and haplotype study of Y-chromosomal multi-STRs loci in Han population in Guangzhou

Using polymerase chain reaction and silver stain, polymorphism and haplotype study of Y-chromosomal multi-STRs loci: DYS19, DYS389I/II, DYS390 were studied. 111 samples of male were collected from Guangzhou area. 5 alleles were determined in DYS19 locus, 4 alleles in DYS389I locus, 5 alleles in DYS389II locus and 5 alleles in DYS390 locus. Compared with other racial populations, differences of distribution of allele frequencies existed significantly. 72 haplotype were present in this study.     

Democratization without decentralization: Local government in Hong Kong

The literature on democratization tends to neglect the question of decentralization. The case of the Hong Kong Special Administrative Region (HKSAR) of the People's Republic of China shows that there can be partial democratization without decentralization. Democratization in Hong Kong took place in the mid‐1980s and 1990s, when more directly elected seats were introduced to political institutions at the territorial, municipal and district levels. However, democratization has not been accompanied by an attempt to decentralize administrative and political power to the institutions at the local level. These political institutions, including the Urban Council (UrbCo), Regional Council (RegCo) and District Boards remain relatively weak vis‐à‐vis the executive branch of the government. The recent attempt by the HKSAR government to abolish the UrbCo and RegCo represents a move toward centralization of administrative and political power. Moreover, District Boards remain consultative and politically powerless. It is the dynamic relationship between democratization and decentralization at which future research should be directed.

依靠科学技术实现军队和国防现代化, 是中国共产党人一以贯之的指导方针。党的第一代领导集体开创了依靠科学技术实现军队和国防现代化的道路, 党的第二代领导集体解决了依靠科学技术实现军队和国防现代化的根本问题, 党的第三代领导集体规划了我军建设的宏图, 全面实施了科技强军战略。在党的三代领导集体的坚强领导下, 经过５０ 年的艰苦奋斗, 军队和国防现代化建设不断迈上了新的台阶。     

市场经济与道德重建

适应市场经济发展的道德理论不仅应具有市场经济基础,而且也应为主体意志的道德约束提供深层的社会心理基础。道德既是价值规范,又是实现价值的实践活动,还是人类利益意志的“人为法则”。市场经济一方面涵摄了人们道德的基础,另一方面为完善道德提供了条件。应从道德和市场经济的内涵和运作中寻求二者的生成关系,阐明正确理解的利益是道德与市场经济相统一的现实支撑点。那种强调在集体利益实现基础上充分发展合理的个人利益的、真正意义上的集体主义道德,应是市场经济条件下道德重建的根本方向和基本内容
