有限合伙的滥用与规制

我国修订后的《合伙企业法》规定了有限合伙制度,完善了合伙形式,但同时也为有限合伙人滥用有限责任侵害债权人利益提供了条件.为规制有限合伙的滥用,需要借鉴国外立法,完善有限合伙资本制度、限制分配制度、有限责任否认制度.

新中国70年文化建设的进程与经验

新中国70年来文化建设始终围绕社会主义制度展开,社会主义改造时期解决的是文化与社会主义制度相适应的问题,社会主义建设时期解决的是制度确立后文化如何发展的问题,改革开放以来解决的是文化发展如何更好地完善社会主义制度的问题,进入新时代则着眼于文化建设如何更好地彰显社会主义制度的优越性。文化建设在完善制度的同时也逐步从外在工具性目的向凸显自身目的性转变,从而走出了一条中国特色社会主义文化发展道路。在此基础上,文章从文化建设与社会主义制度、时空方位和主要矛盾、国家总体布局和文化双重功用平衡以及文化的本质和目的层面总结了70年来文化发展的基本经验。     

论中国民事审级制度面临的挑战及其完善

我国现行民事审级制度不是"舶来品",而是经过漫长的演变过程逐渐形成的。现行法上的"四级两审制"民事审级制度在特定历史时期发挥了其应有的作用,但目前已经无法满足人民群众日益增长的接近司法的需求。我国民事审级制度体系的完善应当确立"四级三审制"、增设职能管辖制度、贯彻上诉利益理论、明确第三审为法律审等基本制度,同时建立允许例外情形下基于法定或意定的原因而适用一审终审制度,以及越级上诉制度和特别上诉制度。     

Reluctant policy innovation through profit concession and informality tolerance: A strategic relational view of policy entrepreneurship in China's urban redevelopment

This paper engages with the theoretical perspective of policy entrepreneurship to examine the pattern and process of policy change in the context of China's urban redevelopment. Drawing upon a strategic-relational reinterpretation of policy entrepreneurship, this paper identifies a distinctive form of reluctant policy innovation in the “three old renewals” scheme initiated in Guangzhou where profit concession and informality tolerance were practiced to create a small window of opportunity for the project of urban redevelopment to break ground. The motivation of policy entrepreneurship in the successful urban renewal projects in Guangzhou was heavily contingent upon the geographically important location of the project site and the historically incidence of hosting the 2010 Asian Games, which forced municipal government to become entrepreneurial and innovative in decision making and income redistribution in order to get things done as quickly as possible. The distinct fashion of policy innovation identified in the case of Guangzhou points to the polymorphous and dynamic nature of policy entrepreneurship and advocates a relational treatment of the strategies and motives of policy entrepreneurs embedded in concrete geographical and historical context.     

Why was apparent evidence ignored? The delayed relaxation of China's birth control

The ideal of evidence-based policy making (EBPM) may be hindered by delayed policy response to disclosed evidence. This article adopts Allison's three-lens decision-making framework to highlight technical, organizational, and political causes of delayed policy responses to apparent evidence. The study uses China's birth control policy as a case to examine the lag of policy adjustments. Although ample supply of evidence suggested earlier relaxation of China's one-child policy, major adjustments only happened after 2013 and failed to achieve significant results. The study indicates that a politics-informed EBPM approach may better position the role of evidence in policy processes by taking into consideration the unavoidable influences of institutions and politics.
