ABSTRACT

We investigated the effect of dialect and race on juror decision making. Mock jurors read a summary of an ambiguous criminal case, which included audio of a defense witness (Study 1) or defendant (Study 2). Both speaker dialect [General American English (GAE)/African American Vernacular English (AAVE)] and race (White/Black) were crossed; Study 2 also included three levels of case (Ambiguous/Pro-Prosecution/Pro-Defense) to evaluate any effects of evidentiary context. In both studies, jurors who listened to the AAVE recording found the AAVE-speaking witness to be less professional and less educated than their GAE-speaking counterparts. Interestingly, jurors in Study 2 who heard the defendant use GAE were more likely to find him guilty and found him less credible when the case favored the prosecution, hinting that ingroup biases such as the black sheep effect may also play a role in perceptions of dialect. Secondary analyses found that AAVE predicted more negative overall evaluations of the speaker, and these negative evaluations were associated with an increase in guilty verdicts. Together, these findings suggest that dialect plays an under-investigated role in the courtroom, and that bias against AAVE negatively impacts juror appraisals of its speakers and can potentially influence juror decision making.  相似文献

We examined blame attribution as a moderator of perceptions of hate crimes against gay, African American, and transgender victims. Participants were 510 Texas jury panel members. Results of vignette-based crime scenarios showed that victim blame displayed significant negative, and perpetrator blame significant positive, effects on sentencing recommendations. Also as hypothesized, victim and perpetrator blame moderated the effect of support for hate crime legislation. Interaction patterns suggested that both types of blame attribution influence sentencing recommendations, but only for participants disagreeing with hate crime legislation. Three-way interactions with victim type also emerged, indicating that the effects of both types of blame attribution show particular influences when the victim is gay, as opposed to transgender or African American. Implications for attribution theory, hate crime policy, and jury selection are discussed.  相似文献

The sulfur dioxide (SO2) cap and trade program established in the 1990 Clean Air Act Amendments is celebrated for reducing abatement costs ($0.7 to $2.1 billion per year) by allowing emissions allowances to be traded. Unfortunately, places with high marginal costs also tend to have high marginal damages. Ton‐for‐ton trading reduces emissions in low damage areas (rural) while increasing emissions in high damage areas (cities). From 2000 to 2007, conservative estimates of the value of mortality risk suggest that trades increased damages from $0.8 to $1.1 billion annually relative to the initial allowance allocation and from $1.5 to $1.9 billion annually relative to a uniform performance standard. With U.S. Environmental Protection Agency (USEPA) values, trades increased damages from $2.4 to $3.2 billion annually compared to the initial allowance allocation and from $4.4 to $5.4 billion compared to a uniform performance standard. It is not clear that the ton‐for‐ton SO2 cap and trade program is actually more efficient than comparable command and control programs. Prior research suggested that when community members are notified that a sex offender is residing in their neighborhood they are likely to engage in precautionary behavior to prevent potential victimization. Since states employ different processes in notifying community members of the presence of a sex offender, it is important to examine the advantages and disadvantages of the various notification processes. The current exploratory study compared the proactive sex offender notification process in Hamilton County, Ohio, with the passive notification process in Jefferson County, Kentucky. Not surprisingly, study findings indicated that the proactive sex offender notification process used in Ohio resulted in better community dissemination of information.  相似文献
