Made in Where？A Wine Provenance Verification System to Root out Counterfeits

CHINA’s first provenance verification system for imported wines was formally unveiled in Shenzhen in November 2012. Its application is expected to strengthen China’s supervision of imported wines, help root out counterfeit products and further protect consumers’ rights. It should also guarantee quicker customs clearance procedures for imported wines     

Further Opening-up of the Cultural Sector

AT the Third Plenary Session of the 18th CPC Central Com- mittee, held last November, the Party proposed to establish a sound modern market system of cultural industry .and to develop a modern public cultural service network, in efforts to promote opening-up of the cultural sector. Jiwu Wuqie：Inheritor of the Yi Ethnic Minority Lacquerware Xiu Craft

Jiwu Wuqie was born to a family of lacquerware craftsmen in Liangshan Yi Autonomous Prefecture, Sichuan province. The Yi lacquerware craft, which Jiwu learned as an apprentice to his lather, has been handed down for 16 generations oi his clan. He has since created 30 variations of its original forms. Jiwu bears the title of craft master of Sichuan Province. His works are sought after in the United States, Japan, Europe and Southeast Asian countries. Jiwu＇s name was added to the list of National Intangible Cultural Heritage Inheritors in 2009.     

Cao Jieming,Dedicated She Inkslab Engraver

Cao Jieming, born in 1954, learned inkslab engraving as a boy from master of the craft Wang L0sen. After 40 years of study and practice of inkslab engraving, Cao has evolved a distinctively refined style, apparent in strong but srnooth carved lines. Cao＇s representative works have won rnultiple awards at national and international exhibitions. In 2006, Cao was officially designated as national representative inheritor of the She inkstab making craft.

试论信赖原则在认定交通事故责任中的运用——兼评新近修订的《道路交通安全法》

信赖原则是指当行为人实施某种行为时,如果可以信赖被害人或者第三人能够采取相应的适当行为的场合,由于被害人或者第三人不适当的行为而导致结果发生的,行为人对此不承担责任的原则。关于我国能否适用信赖原则有肯定说和否定说之争。我们认为,信赖原则在我国目前的法律法规和司法解释中已有所体现,目前的问题是如何正确适用。正确适用信赖原则需要考虑很多因素,如交通双方条件、事故发生的具体环境、行人一方的具体情况、机动车一方能否预见和避免等。现行信赖原则的有关法律规定还有待进一步完善。     

澳门刑法中叛国罪的犯罪构成研究

澳门《维护国家安全法》以特别刑法的形式确立了澳门刑法中的危害国家安全罪。依据“主客观相统一”的刑法基本原则,从叛国罪的危害行为、危害结果、因果关系、主观要素中的罪过形式等方面进行法律分析,有助于绘制出了澳门刑法中叛国罪的犯罪边界。     

论我国宪法司法适用的空间

宪法司法适用不等同于违宪审查或宪法诉讼 ,它所涉及的是普通法院在审理民事、行政以及刑事案件时能否附带进行违宪审查或直接援引宪法条款来裁决民事、行政、刑事案件的问题。人民代表大会制并不意味着我国宪法没有司法适用的空间。事实上 ,人民法院完全可以在以下三个方面适用宪法 :对行政机关和社会组织抽象行为的附带性违宪审查、宪法的民事适用和刑事适用。     

我国劳动争议纠纷解决机制的缺陷与对策

我国现行的劳动争议纠纷解决机制可以归结为“一裁两审”的单轨制模式。该模式在历史上曾经起过积极的作用，但随着社会主义市场经济的进一步深化和我国加入WTO，劳动争议纠纷解决机制存在的缺陷越来越受到人们的关注。面对这种现状，我国劳动争议纠纷解决机制的改革和完善显得十分必要。
