An Application of the Theory of Communicative Competence in the Analysis of Juror's Decision-Making Structure

This study applied the theory of communicative competence in analyzing the juror's decision-making structure. The primary thrusts of this study were 1) to ascertain whether or not presuppositions or value laden data affect a juror's decision-making process and 2) to uncover common sense ground during a court trial.

Findings indicated that an imbalance existed between interpretations of both hard and soft data. This study questions the distorted system of communication and suggests methods of improving quality through reaching mutual consensus. The theory applied in this study was grounded in a culture of rational discourse. Finally, it was found that the manner in which the prosecution and defense construct their lines of questioning influences the juror's decision-making process.

“Juvenile detention is regularly overlooked, maligned, and misunderstood. Its embattled condition is best described as severely abused and neglected. It is underfunded, understaffed, crowded and largely ignored.”¹ “Detention caseloads increased 38 percent between 1987 and 1996. The increase in the number of delinquency cases handled by the courts has driven the growth in the number of juveniles in the detention system. In 1987, 1.2 million delinquency cases were disposed of in juvenile courts. By 1996, this number had risen 49 percent, to almost 1.8 million. This increase in the volume of juveniles in the justice system resulted in a 38 percent increase in the number of delinquency cases that involved the use of detention. The number of juvenile delinquency cases detained in 1996 was 89,000 more than in 1987. This has resulted in increased demand for juvenile detention bed space across the country.”² “Changes in statutes allowing more detainable offenses have significantly increased the number of youths admitted to regional detention centers.”³ “Although minority youth constituted about 32 percent of the youth population in the country in 1995, they represented 68 percent of the juvenile population in secure detention…⁴     

Trauma Interventions and Systems Change in Rural Areas: The Role of the Juvenile Court Judge in Collaboration with Mental Health Professionals

This article will focus on the evolution of the collaborative work of the Louisiana Rural Trauma Services Center (LRTSC), a Center within the National Child Traumatic Stress Network, and the 23rd Judicial District, a jurisdiction in south Louisiana serving three rural parishes. We will describe how the collaboration and joint efforts, and the changes that have been made in terms of availability of evaluation and treatment resources, seem to be influencing both the educational and judicial systems in St. James Parish and potential sustainability of some of the identified resources. The article will examine how the court and the LRTSC work together with emphasis on the evaluation, reporting and recommendation processes, outcomes and benefits to date, and challenges for the future.
