Understanding governance in the world's democracies requires study of the political institutions — the chief executives, the bureaucracies, and the legislatures — most involved in national policymaking. There are many approaches to the study of these institutions. This article examines the potential of an approach which is relatively unfamiliar to most students of governance: the development of formal mathematical theories of political institutions. The costs and benefits of this approach are discussed, various types of formal theories are surveyed, and a variety of possible applications to some central problems of governance are described.  相似文献

It was only a few years ago that in most jurisdictions across the United States, decisions at each stage of a child welfare case were made by individual professionals (law enforcement, child protection workers, social workers, and judges) who were all a part of the community's response to child abuse and neglect crises. In the last decade, the development and continuing evolution of best practices have brought about many changes in how professionals approach the resolution of these issues, how they convene interested persons in the decision‐making process, and how families and children participate in decisions. This article will examine some of these changes, with a particular focus on the expanding use of groups and the inclusion of families in these groups to make better decisions in child protection cases.  相似文献

Both in the United States and the European Union, patent policy instruments in information and communication technologies are contested. Although current reform proposals would lead to a uniform patent eligibility for computer programs in both economic spheres, such an outcome is rather unlikely. In a theoretic perspective, contrasting policies in one of the most important technology sectors challenge the expectation of converging regulative regimes. In a view to reveal the structural causes for the persisting divergence, it is argued that incompatible underlying paradigms, differentiated patterns of power structure, and unsynchronized institutional arrangements may resist even strong pressures to harmonize regulative practices. The interaction between these elements will be addressed and discussed as a perspective to define restraints on the scope of convergence theories.  相似文献

Today, judges are faced with the daunting task of determining the best interests of the child and making appropriate custody awards to that end. The best interests of children becomes a critical question when domestic violence is involved; yet, determining what constitutes domestic violence is often debated. Research is often divided on what constitutes domestic violence. One body of research focuses on conflict, another focuses on domestic violence. What the first group identifies as intense emotional distress and disagreement, the other identifies as abuse. Judges making custody determinations in such cases are faced with the difficult challenge of distinguishing between a divorce with “high conflict” and a domestic violence case with ongoing abuse. This article will summarize the legal, philosophical, and historical understandings of the “high conflict” family and its potential impact on children. It will also provide practical judicial guidelines for making the important distinction between high conflict and domestic violence and subsequently crafting appropriate and safe child custody awards.  相似文献

Disproportionate involvement in violent behavior among African American, versus white, adolescents is a major arena of debate in the social sciences. The individual difference approach draws attention to verbal ability as an explanation of black‐white differences in violence. Sociological theories stress variation in community and family socioeconomic disadvantage. We contrast these causal images of racial differences in serious violence using the National Longitudinal Survey of Adolescent Health and contextual modeling. Results indicate that verbal ability has an indirect effect on violence through school achievement, but does not account for the greater involvement in violence among black adolescents. The analysis is most consistent with a sociological model that views the race‐violence link as a spurious outcome of community context.  相似文献
