This article argues for community-based justice to confront the atrocities of residential schools in Canada. After considering the strengths of community-based restorative justice (CBRJ) in relation to state-sponsored transitional justice responses, I examine a case study of the Remembering the Children Society (RCS), an Indigenous church partnership, that has worked to commemorate children who lost their lives at the Red Deer Industrial School. The RCS engages in a decolonizing form of CBRJ by placing primacy on Indigenous cultures through (1) feasts and ceremonies, (2) freeing the spirits of children who died, (3) the centrality of elders, and (4) Aboriginal spirituality and world views on ‘working together’. The centrality of cultures contributes to decolonization through (1) cultural resistance in the face of assimilation, (2) the healing power of cultural resurgence, (3) the development of mutually honoring partnerships, and (4) the telling of decolonizing truths. In conclusion, I consider the broader impacts of the RCS in helping transform official narratives about residential schools.  相似文献

East Asian cultures are widely held to be fairly homogeneous in that they highly value harmonious social relationships. We propose, however, that the focus (dyadic versus group) and the nature (emotional versus instrumental) of social relations vary among the Chinese, Japanese, and Korean cultures in ways that have important implications for the negotiation tactics typically employed by managers from these three cultures. Our data are from a web survey administered to three hundred eighty‐eight managers from China, Japan, and South Korea. In this article, we discuss how the differences in the focus and the nature of business relationships in China, Japan, and Korea are manifested in the different norms for negotiation tactics endorsed by managers from these three countries.  相似文献

The objective of this study was to determine the presence of corticosteroids in illegal herbal medicines using ultra‐high‐performance liquid chromatography–tandem mass spectrometry. We collected 212 herbal medicine samples that were advertised as being effective for treatment of joint pain and bone aches. Samples were from the Korean commercial market during a span of four years (2010–2013), and the method was validated. The limits of quantification ranged from 0.47 to 15.0 ng/mL, and recoveries ranged from 80.6% to 119.5%. The intra‐ and interday precision ranged from 0.18% to 8.82% and from 0.09% to 8.96%, respectively. Among the samples, three samples (1.4%) were identified as adulterants. Dexamethasone was the only compound detected in the adulterated products. As the corticosteroid–adulteration of herbal medicines may become a major problem and lead to side effects, the continued development of screening procedures for herbal medicines is critical.  相似文献

From 1931 to 1941, when China and Japan were at undeclared war, China's propaganda was fairly well-circulated in America through her American friends who played a leading role in shaping American opinions on the Far Eastern crisis. But the United States State Department maintained a neutral stance toward the Sino–Japanese conflict until after 1939 and considered the pro-Chinese opinion not so much a national consensus for policy consideration as a partisan view propped up by propaganda groups. Thus, the State Department guarded its Asian policy from the pressure of propaganda activities and partisan opinions on the Asian conflict, whilst utilising them occasionally as tools of diplomacy toward China and Japan. This article examines the State Department's attitude toward public opinion and propaganda on the Far Eastern conflict from 1931 to 1941 to illustrate how American officials handled partisan opinions on a foreign crisis when most of the information on foreign policy was privately initiated and circulated.  相似文献

Rapidly growing concerns about the adverse effects of climate change are prompting a re-thinking of how companies view their strategies and operations and spurring legal and regulatory responses around the world. The overarching objective of these efforts is to facilitate and accelerate the transition to a more sustainable economy. The green transition will have substantial distributional and structural implications for workers and the workplace across companies and economic sectors. Indeed, the future of work will be significantly shaped by climate change. However, relatively scant scholarly attention has been devoted to the forward-looking legal implications of climate change for work. Similarly, legal scholars writing on climate change have largely neglected the laws governing employment. This article seeks to help fill that gap. How can companies, workers, and society respond to the green transition in a manner that enables better jobs, a safe and stable workplace, and more resilient companies? To answer this question, this article draws on the theory of just transition, which is rooted in environmental justice and labor rights. We offer an interpretation and application of just transition that expands its scope to serve as a blueprint for ethical business conduct and legal reform to improve the world of work and the lives of workers.  相似文献

Scholars have debated what constitutes effective ministerial leadership with respect to administrative competence versus political influence. The authors contribute experimental evidence to this debate through a unique survey design of endorsement experiments. Using original data from 949 national civil servants in South Korea, this article examines civil servants’ assessments of ministerial leadership in three central dimensions of public management: internal management, interbranch coordination, and policy formulation/implementation. Further, existing variation in the characteristics of agencies is used to test whether such variation induces systematic differences in civil servants’ responses. Findings show that that civil servants’ attitudes toward ministerial leadership are asymmetric in nature. Ministers with civil service backgrounds are endorsed in all three dimensions, whereas ministers with legislative backgrounds receive increased support only for interbranch coordination skills. The levels of support for ministers with different backgrounds also vary across agency types. This analysis has implications for public management practice and agency control in presidential governments.  相似文献

Interlocal collaboration is considered an important tool for cost-saving. States, therefore, have incentivized interlocal collaboration in different ways. To understand the budgetary consequences of interlocal collaboration and state incentives, we examine counties in Nebraska where the State uses two incentive mechanisms—resource restrictions and additional access to restricted revenues granted to counties with collaboration. This study finds that county expenditures are lower when they spend more through collaboration. While this lower spending is related to lower revenues in counties less constrained by state restrictions, the results for counties more constrained are unclear. State incentive structures may matter for such variations.  相似文献

In paternity testing using the DNA evidence, analysis of the deficiency case when the DNA profiles of the alleged father are not available is different from that of the case with complete evidence.
