This article addresses a series of paradoxes regarding informal settlements in cities in the developing world and their relation with the legal system. The first paradox regards the penalization of illegal land occupations on the one hand versus the legalization of that same practice on the other. Second, it looks at the relationship between land occupations as systematic violations of property rights, but with the goal of forming new property rights and thus paradoxically supporting private property as a substantive principle. Third, the reasoning behind the fact that the same system that denies legal access to housing for poor sectors simultaneously attempts to incorporate informal settlements in an ad hoc manner through legalization schemes is examined. It is shown that there is a logic to these paradoxes, which, although contradictory from standard legal perspectives, can be accommodated within a theoretical framework that distinguishes an internal normative order operating within informal settlements, from the state legal system, operative outside it. The proposed framework not only settles the paradoxes, but, this article concludes, can also guide attempts to deal with the enormous anticipated growth of informality in the developing world. 相似文献

Abstract Child molesters (n=13) and sexually non-deviant subjects (n=29) were immersed with virtual characters depicting relevant sexual features while their sexual arousal and gaze behaviour were assessed to characterise their sexual preferences and intentional dynamics. Sexual arousal was measured using circumferential penile plethysmography (PPG). Gaze behaviour dynamics were derived from average gaze radial angular deviation (GRAD) and GRAD coefficient of variation (GRADCV). Results show distinct sexual arousal profiles according to sexual preferences and point towards the existence of specific gaze behaviour dynamics guided by sexual intentions. Theoretical interpretations are based on the ecological psychology of J. J. Gibson, the extended mind theory and the integrated theory of sexual offending. Theoretical underpinnings stemming from these approaches are advocated as being especially well suited to explain how virtual reality can help probing into child molesters' phenomenology as lived from the “first-person” stance. 相似文献

Summary In 1791 there were published eight weeklies and one fortnightly in the British North American colonies which, in 1867 and the following years, united to form the Canadian confederation. The British newspapers served them all as principal sources of information about the events in Europe. The positive and sympathetic press reports in Great Britain relating to the momentous changes in Poland, which were introduced with the adoption of the 3 May 1791 Constitution by the Diet, were thus also ‘echoed’ in Canada. These ‘echoes’ notwithstanding, judging by the scope of press coverage, which started on 4 July 1791, as well as by some editorial comment, it can be concluded that there also existed a genuine interest in Canada about the progress of the peaceful Polish ‘revolution,’ which contrasted so sharply with the bloody strife in America and France. 相似文献

AbstractFor decades, economists concerned with the problems of economic development have noted the typical existence of surplus labor in heavily populated, underdeveloped countries, most notably those of Asia, in which the factor endowment consists of abundant and often rapidly growing labor forces coupled with scarcity of both land and capital. In such countries, the vast majority of the population usually is engaged in agricultural activities and, at a minimum, is characterized by substantial seasonal unemployment during the slack agricultural times of the year and, more typically, also has substantial disguised unemployment throughout the entire year. Also characteristic of such countries is a continuing large-scale migration of labor from rural to urban areas, which transforms the disguised agricultural unemployment into open urban unemployment as the newly (and not-so-newly) arrived urban residents discover that the jobs they seek are substantially fewer than the number of job-seekers. Furthermore, even those fortunate enough to find urban employment often appear to be substantially underemployed, for example, in jobs within the government sector, in petty retail trade, and as messengers and private household servants. Even in countries that have been experiencing relatively high levels of investment and fairly rapid rates of economic growth, the employment problems are far from eliminated and cause social and political problems as well as economic ones. It seems ironic that in such countries there exists simultaneously so many people seeking work and so much work that could be accomplished and could raise basic living standards if the unemployed (and underemployed) workers could be engaged in productive (and more productive) activities. 相似文献

There are growing pressures for the public sector to be more innovative but considerable disagreement about how to achieve it. This article uses institutional and organizational analysis to compare three major public innovation strategies. The article confronts the myth that the market‐driven private sector is more innovative than the public sector by showing that both sectors have a number of drivers of as well as barriers to innovation, some of which are similar, while others are sector specific. The article then systematically analyzes three strategies for innovation: New Public Management, which emphasizes market competition; the neo‐Weberian state, which emphasizes organizational entrepreneurship; and collaborative governance, which emphasizes multiactor engagement across organizations in the private, public, and nonprofit sectors. The authors conclude that the choice of strategies for enhancing public innovation is contingent rather than absolute. Some contingencies for each strategy are outlined. 相似文献

Depuis les années 1980 les approches cognitives des politiques publiques rencontrent un grand succès. Nous nous interrogeons ici sur leur contenu en le confrontant à la cognition telle que la pensent les sciences du même nom (principalement ici la psychologie cognitive) qualifiée de cognition forte. Après avoir défini trois types d'intégration des sciences cognitives aux sciences sociales (terminologique, méthodologique et théorique), nous cherchons à classer plusieurs approches de politiques publiques en fonction de notre taxinomie. Nous observons que dans la majorité des cas, les références à la cognition ne visent pas à transférer une théorie d'une discipline à l'autre. La cognition étudiée par les analyses des politiques publiques est le plus souvent une cognition faible, sauf exceptions. Nous concluons en examinant les enjeux épistémologiques soulevés par ces dernières et tâchons d'avancer quelques pistes pour expliquer ce phénomène. 相似文献
