Summary This article examines the problems faced by the Portuguese Cortes between 1821 and 1823 in attempting to create a constitution. This involved the central issue of whether or not sovereignty resided in the nation or in the person of the king. It led to a polarisation between traditionalists and liberals, although the latter believed that co‐operation between king and Cortes was a precondition for political and social stability. There were also disagreements about whether a royal veto over legislation should be conceded and whether or not a second chamber should be created. A compromise was found over the former, with the Crown receiving a suspensive veto, while a second chamber was rejected. Nevertheless, Portuguese liberals remained divided over the exact role of the Crown within the new constitutional order and that division, combined with the continued strength of traditional forces and external pressures, opened the way for a counterrevolution. Faced with intransigence on the part of the king and the traditionalists, the liberals could only protest by suspending the Cortes. João VI's reply was the declaration of Vila Franca (1823) which proclaimed royal sovereignty and replaced the Constitution of 1822 with one which was only a ‘gift’ from the Crown. 相似文献

This article explores the controversies provoked by two recent exhibits in which People for the Ethical Treatment of Animals (PETA) draws analogies between animal exploitation and the Holocaust and slavery. PETA's comparisons between the plight of animals and that of Jews and blacks are transgressive insofar as they disrupt settled notions of species difference by challenging the sacrosanct moral divide between humans and animals, and insofar as they do this by re-connecting race and species difference in a historically charged way. In the end, the controversies over PETA's exhibits raise difficult questions about the intersection of race and species as hierarchical categories ordering social life, what comparisons are “inadmissible” and why, and the responsibilities or obligations one social justice struggle might be said to have toward other struggles. 相似文献

ABSTRACTThis chapter addresses two crucial issues raised by Laborde’s superb Liberalism’s Religion. The first pertains to where the liberal democratic modern state draws the line between the self-governing prerogatives of religious nomos communities and their regulation by the civil law; the second pertains to the prerogative of the state to do the relevant line drawing. Theorists concerned with religious freedom focus on the first set of questions under the rubric of ‘accommodation.’ The issue is unfair discrimination. I focus on Laborde’s approach to the second. This is again an important issue due to the recent revival of jurisdictional political pluralism: an approach that challenges the supremacy of the civil law and of the authority of the sovereign state over domestic religious authorities. Research indicating high rates of chronic disease among some clergy groups highlights the need for health programming for clergy. Like any group united by similar beliefs and norms, clergy may find culturally tailored health programming more accessible and effective. There is an absence of research on what aspects clergy find important for clergy health programs. We conducted 11 focus groups with United Methodist Church pastors and district superintendents. Participants answered open-ended questions about clergy health program desires and ranked program priorities from a list of 13 possible programs. Pastors prioritized health club memberships, retreats, personal trainers, mental health counseling, and spiritual direction. District superintendents prioritized for pastors: physical exams, peer support groups, health coaching, retreats, health club memberships, and mental health counseling. District superintendents prioritized for themselves: physical exams, personal trainers, health coaching, retreats, and nutritionists. Additionally, through qualitative analysis, nine themes emerged concerning health and health programs: (a) clergy defined health holistically, and they expressed a desire for (b) schedule flexibility, (c) accessibility in rural areas, (d) low cost programs, (e) institutional support, (f) education on physical health, and (g) the opportunity to work on their health in connection with others. They also expressed concern about (h) mental health stigma and spoke about (i) the tension between prioritizing healthy behaviors and fulfilling vocational responsibilities.
