An Assessment of the Validity of Polygraph Examinations for the Psychophysiological Detection of Deception: A Judicicial Opinion and Research Study Review

The polygraph device has been advanced by proponents as a valid (measures what it is supposed to measure, even against counter-measures), accurate (it does what it is supposed to do), and reliable (produces consistent outcomes) diagnostic tool able to measure physiological responses indicative of deception. These physiological responses are said to be a direct result of psychological arousals. (National Research Council [NRC] of the National Academies, The polygraph and lie detection, 2003). A debate concerning the validity of this test instrument has maintained for over 85 years, since the first polygraph device was introduced. This analysis takes into account court cases that address the issue and the available literature and relevant studies that support judicial decision-making. The conclusion arrived at is that this particular testing device has not attained a level of scientific support to warrant unqualified judicial acceptance.     

The Legal Status of Three Sino-US Joint Communiques

Many would agree that the Sino–US relations are one ofthe most important bilateral relations in the world today, andthe three communiqués signed by the two governments arethe most significant agreements signed so far in managing theirrelationship. This article attempts to examine these joint communiquésagainst their contents and historical backgrounds, and triesto discern their legal status under both international law andUS domestic law. It concludes that they bear features of treatiesunder international law and should be regarded as legally bindinginstruments on the international plane, and that their statusunder US law seems ambiguous in the absence of any court rulingsup to date.     

Emerging Organized Crime in Chicago

Organized crime is now international in scope and unrestricted by geographical borders. Better organized, more sophisticated, and using high-tech equipment the criminals have developed connections with so-called 'traditional organized crime'. This paper examines in detail the wave of organized criminal activity which has developed in Chicago and has now become entrenched through alliances with existing criminal groups.     

New Institutionalism and Naturalism in Socio‐Legal Analysis: Institutionalist Approaches to Regulatory Decision Making

Through drawing on the work particularly of sociological and organizational theorists socio-legal work has added considerably to an understanding of the uses of law and discretion, and shown the contingency of the operation of law on the economic, political and organizational context. Some important questions still remain unanswered, however. In particular, if in decision making law is not determinative, but rather decisions are shaped by other bureaucratic or organizational norms, political and economic pressures and an individual's own world views and interests, what role does law play? Further, what impact does the decision process, in which different norms or considerations all bear, have on law? In starting to answer these questions the article examines the models of decision processes and decision behavior which underly the different new institutionalist analyses, and suggests that whilst they provide some insights, they have their own limits.     

Defense Supplementals and the Budget Process

Supplemental appropriations provide emergency adjustments to the current year, usually for national defense contingencies and natural disaster emergencies. Recently, they have adopted some of the complexities of the regular appropriation process. For example, both the president and Congress may suggest when a supplemental is a dire emergency and thus beyond spending discipline and when it must be offset. Some supplementals have paid for nonemergency activities, others have resulted in funding decreases, and still others have resulted in spending in future years. Compared to the normal appropriation process, supplementals are usually passed expeditiously. Defense supplementals are generally precisely priced, whereas disaster supplementals tend to be lump sum estimates.
