注：奔津门赴“海河论坛”之约前突获“犯罪学茶楼”楼主皮艺军教授约稿并叙及《青少年犯罪问题》主编姚建龙君催稿,于是匆匆翻阅了几份载有当今“中国犯罪学研究会”领军主帅王牧会长的文章,顿生与王牧君共品犯罪学“茶素”之念。无奈行色匆匆,只好招来亲授弟子翁连金趋舍下共品其味,并叙其将鄙见与共识形成如下浅识,可视为离开犯罪学科坛十年、     

对新媒体环境下高校隐性思想政治教育的思考

当前,新媒体己成为大学生学习、生活须臾不可分割的一部分.相对于传统的显现思想政治教育方式,隐性思想政治教育具有教育方式隐蔽、教育时空开放、教育过程持久等独特优越性.新媒体与高校隐性思想政治政治教育极强的关联性,不仅体现在新媒体作为一把“双刃剑”为高校隐性思想政治教育带来新的机遇和挑战,也体现在本身应用于高校隐性思想政治教育的必然性.在新媒体环境下,从完善高校隐性思想政治教育的考评体系着手,依靠思想政治教育工作者和大学生共同努力,并且依托新媒体唱响思想政治教育的主旋律是当前应对新媒体对隐性思想政治教育的挑战提出的几点措施.     

中美司法精神病鉴定现状比较

美国的司法制度分联邦及州两大系统,且联邦与州之间、州与州之间司法制度不尽相同.在司法精神病学鉴定上,美国一直沿用判例法,且由于各州的差异,在全国范围呈多元化的特点.我国虽是一个多民族的国家,但除香港特别行政区及澳门、台湾外,通用统一的共和国法律.在司法精神病学鉴定上,主要借鉴大陆法系的观点,且全国依据统一的法律条款和法定标准,从事此项工作的人员,尽管在个别具体的学术观点上尚有分歧或争议,但实践中的具体运作及应用的结果基本一致.     

论涉众型经济犯罪案件中的维权——以与维稳的衡平为视角

涉众型经济犯罪是从维稳角度提出的概念,是涉及众多经济利益受损群体,可能影响社会稳定的经济犯罪行为.涉众型经济犯罪案件中的权利包括参与人在涉足该类案件前的财产权利即原权利和利益受损群体寻求救济的权利即派生权利.要做到精确维权和依法维权,必须明确原权利维权主体的范围,明确国家机关的辅助维权地位.要鼓励利益受损群体通过法律规定的方式维权,制裁和避免极端的维权方式.要正确认识维权与维稳的关系,正确看待政府在维权过程中的作用,对现行“先刑事后民事”的法律制度进行完善,同时实现维权与维稳法律效益.

我国社会主义法律体系已然建成,书面上的法需要变成行动中的法,法律规则及其体系的目标需要实现,于是,法律实施作为专门的研究对象,并由此而形成新的学术研究领域,就有了历史和逻辑的必然性.法律实施学的构建以法律社会工程论、法律过程论以及对形式主义法学的扬弃为理论基础,以法律实施为对象,围绕守法、执法、司法和法律监督四个方面分层次展开研究,从而构建起完整而富有逻辑性的学术学科体系.

Under the shadow of the financial crisis, the year 2009 presented numerous signs that the world is polarizing in terms of power balances, strategic readjustments by the world powers, and relations between these world powers.
