悲剧品格与精神生态

文学从来都是人学。人的精神性的存在一直是美学和文艺学的思想主题。悲剧是文学艺术的最高形态;悲剧理论是美学思想的重要组成部分。本文从悲剧起源、悲剧品格本质和中国悲剧文学缺失三个方面论证了悲剧品格能够完善人的精神性的存在,能够维持人的自然性、社会性、精神性的三角平衡,提出悲剧品格对于建立良好的精神生态系统不可或缺。     

检察机关参与社会大调解化解社会矛盾问题研究

在经济快速发展、社会转型的新形势下,各方面、多层次的矛盾日益凸显,加大对矛盾纠纷的调解力度,完善调解手段,成为目前维护社会稳定,促进社会和谐发展的重要举措,检察机关也应充分发挥其调解职能,积极化解社会矛盾。     

东盟的大国平衡战略与中印的东盟外交

东盟(ASEAN)因其地缘政治、地缘经济的重要性引得区外大国在此竟相逐鹿。东盟正是利用这一优势,巧妙地与各大国周旋,积极推行大国平衡战略,谋求东南亚地区的繁荣与稳定。中印两国则成为这一战略的实施对象,相互竞争而又相互制约。中印两国应如何看待这一战略,又如何扮演在其中的平衡角色,本文拟就此作浅显的分析。     

The size of the SOE sector and macroeconomic performance: an empirical study based on Chinese provincial data

Using a neoclassical growth model augmented with human capital, we investigate the impact of the presence of state owned enterprises (SOEs) on macroeconomic performance in China, using provincial data from 1990 to 2004. We estimate a macroeconomic model with panel methods to explain changes in labor productivity resulting from standard influences as well as presence of the SOE sector measured in five different ways. While controlling for growth in the labor force and physical capital, government size, exposure to trade and change in economic structure, we conclude that the relative share of the SOE sector has no significant influence on macroeconomic performance in China during our sample period.     

明清州县监狱狱囚生活处遇制度研究

狱囚的生活处遇是监狱管理的一项重要内容，与前代相比，明清时期，州县监狱在狱囚生活处遇方面的制度和法规都有了明显进步，达到了相当完善的程度，但是，这些制度与规定在许多时候都不能得到切实的执行，狱囚的生活仍然相当悲惨。这表明，在古代社会，狱囚的生活处遇制度并不意味着承认囚犯的人权，而是为了体现统治者的仁厚，狱囚生活处遇的实际情况很大程度上受制于政治的清明程度，这使狱囚的生活待遇缺乏稳定性和保障。     

以自由看待权利 以权利看待法治——读杨春福教授《自由·权利与法治》

杨春福教授<自由·权利与法治--法治化进程中公民权利保障机制研究>一书综合运用哲学、历史学、经济学、社会学和政治学等诸多学科的理论和方法,从多维视角透视自由,提出"自由主义视野下的权利" ,包括两层主要涵义:自由主义以权利为基础,权利以自由为核心.书中着重分析了权利的法定性,明确划分法治的显性要素和隐性要素,并将权利的概念纳入作为系统工程的法治的各个组成要素.该书锁定公民权利和法治社会两个核心概念,指出法治社会的基本标准即公民权利与国家权力关系的理性架构,具体地体现为三个方面的内容:公民权利是国家权力的基础;公民权利是国家权力的界限;公民权利是国家权力的目的.在此基础上,提炼出法治社会的核心评价标准,即对公民权利的保障程度.     

An effective punishment scheme to reduce extramarital affairs: an economic approach

By using a dynamic stochastic optimization model, this paper shows that the existence of punishment does not necessarily deter extramarital affairs. This study may help to explain why extramarital affairs are a common phenomenon in most societies even though punishment exists. This study also has an implication for family laws: extramarital affairs can be effectively reduced if the legal punishment scheme is designed in the way that makes the adulterer’s expected loss increase with the level of adultery at an increasing or constant rate.      

Referendums and the Political Constitutionalisation of the EU

Abstract:  This article argues that European integration has triggered a dual constitutionalisation process in Europe. One is the revision of national constitutions to accommodate the integration project at the national level. The other is the construction of transnational rules to regulate novel inter-state relationships at the European level. EU referendums are contextualised in such a duel constitutionalisation process. At the domestic level, EU referendums handle the debates on national constitutional revision. At the transnational level, these popular votes ratify supranational constitutional documents. The article comparatively analyses three types of EU referendums—membership, policy and treaty referendums—according to this analytical framework, exploring the campaign mobilisation of voters, national governments, and transnational institutions, and examining the legal and political interaction between referendums and European integration. A key finding is that, as the dual constitutionalisation process deepens and widens, entrenched domestic players and restrained transnational actors are under increasing pressure to 'voice' themselves in EU referendums.
