论人本主义版权保护理念

版权保护的财产权劳动学说与财产权人格理论兴起于人的理性价值彰显的年代,虽思辨、浪漫有余,但严密性不足;版权保护的工具主义理论则缺乏必要的价值引领.人本主义注重关照感性的具体个体的生存样态,以现实主义面向弥补了理性建构理论的不足.面对技术理性的侵蚀,人本主义在金钱至上、传媒垄断文化市场的当下仍能凸显人的价值.着眼于版权主体利益不均衡状态,人本主义版权保护理念的实现应从创作者和使用者权益入手.在具体制度设计方面,应适当提升网络平台注意义务标准,发挥集体管理组织和版税费率制定组织的作用,确立创作者合同权益的保障机制,并从作品的获取、持有与再创作三方面切入,保护使用者权益.     

One-Sided Discussions: Deliberation in Weblogs during the 2009 National Election

Against the backdrop of the 2008 Obama campaign, participatory online tools were one main component of parties' campaigning strategy in Germany 2009. They used a wide variety of online tools to communicate directly with the voters. While political actors reiterated to accentuate the discursive potential of such tools, sceptics questioned whether such instrumental campaign communication can facilitate sound political discussions. The article analyses whether or not the internet fostered citizen participation during the 2009 national election campaign for the German Bundestag. A content analysis of the posts and comments in the weblogs of the major parties, CDU and SPD, was conducted. Results reveal that participation took place only on a very low level. Furthermore, the few comments published (370 in four weeks) failed to meet basic requirements of deliberation such as objectivity or argumentativity. Moreover, both parties actively prevented a free discourse as single comments may not have been authorised.

财产之于人生的幸福既是一种朴素的情感，也是财产权理论中的一个根本性问题。从财产给予人类的情感价值来说，它包括拥有之乐、获取之乐和利用之乐三个维度。拥有之乐，表达的是财产权所具有的个人情感，目的在于建立起财产权利的边界；获取之乐，实现的是财产权的人生价值，乐在享受财产权力；利用之乐，建立在财产能力之上，体现了财产权所承载的社会意义。建立此种财产价值观，财产权才能作为一种公共政策的工具，在创造个体幸福的同时，也带来整体的共同福祉。     

Organising development: Comparing the national systems of entrepreneurship in Sweden and South Korea

The dominant paradigms of economic development have created an artificial institutional division between spontaneous markets and instrumental states. Opposing policy agendas have evolved and remain entrenched. This article seeks to challenge both approaches by reconsidering the role of entrepreneurship in economic development. Adopting an evolutionary perspective, it argues that a national system of entrepreneurship provides an appropriate framework for combining the creative and destructive processes inherent in entrepreneurship with the institutional diversity characteristic of successful economic development. The article illustrates this argument by comparing the development experiences of Sweden and South Korea.     

Unchanging child support orders in the face of unstable earnings

The underlying theory behind child support guidelines implies that child support orders should change when the incomes of noncustodial parents change. This paper documents changes in noncustodial fathers' earnings over a five‐year period and examines the relationship between the changes in earnings and modifications in child support orders. Using detailed longitudinal administrative data from Wisconsin, the authors examine the history of orders and earnings for fathers in couples who had their first child support ordered in 2000. A substantial proportion of fathers experience large changes in earnings, but relatively few of the associated child support orders are modified. Using discrete‐time multinomial event history models that consider time‐varying variables and control for censored observations, we find some evidence of changes in earnings being associated with changes in orders, all else equal, but the relationship is relatively weak and order changes are not proportional to earnings changes. The findings highlight the challenges and importance of developing policies that result in child support orders being more responsive to changes in fathers' incomes. © 2010 by the Association for Public Policy Analysis and Management.

两种β_2受体激动剂快速免疫检测方法

分别以偶氮方法和碳化二亚胺（ＥＤＣ）方法将β２受体激动剂克伦特罗（ＣＬ）和塞曼特罗（ＣＩＭ）连接到载体蛋白上，并以连接物免疫家兔，分别制备兔抗ＣＬ和ＣＩＭ抗血清，经间接ＥＬＩＳＡ和间接抑制ＥＬＩＳＡ检测抗血清效价和特异性，并在此基础上建立了ＣＬ和ＣＩＭ快速免疫检测方法。２种抗血清工作浓度分别为１∶１００００和１∶５０００。ＣＬ和ＣＩＭ免疫检测范围分别为１．９ｎｇ～１５．６μｇ和０．４７７ｎｇ～１．８５μｇ。２种β２受体激动剂快速免疫检测方法的建立为监督畜牧生产上滥用ＣＬ和ＣＩＭ，检测肉品ＣＬ和ＣＩＭ残留提供了一种简便、灵敏、特异的手段。
