The European Union and gender mainstreaming: Constitutionally embedded or comprehensively marginalised?

This paper examines the extent to which gender mainstreaming is constitutionally embedded in the legal framework of the European Union. Within the framework of that broad question it examines three sub-questions concerning the robustness and constitutionalised nature of the E.U.'s `equality regime', the extent of adaptation to mainstreaming methodologies by supranational institutions such as the Court of Justice, and the extent of the gender dimension in the debates which are shaping the future of the European Union, especially the 2002–3Convention on the Future of the Union and the Commission's Governance White Paper of 2001.The E.U. is analysed in this article as an emergent, non-state, postnational constitutionalised polity. The first section presents this perspective, and the succeeding three sections engage with the three` sub-questions' outlined above. The conclusion suggests that as yet, while gender concerns maybe constitutionally embedded in the Treatyframe work, they are less prominent in the constitutional politics of the Convention and the Governance White Paper.

Las reformas políticas en el gobierno de Sebastián Piñera Chile, 2010-2013

This paper analyzes political reforms carried out by Sebastián Piñera’s government in Chile. Te reforms considered are those that his Coalition for Change campaigned on as part of the presidential and legislative elections in 2009. Tese reforms promised an improvement in the quality of democracy, and promised its consolidation, including increased political participation, in order to counter the most common criticisms of institutions of representation. Throughout this process, the government showed little receptivity to proposals coming from other sectors, both of the ruling coalition and the opposition; furthermore, it paid scant attention to growing citizen protests and their demands voiced since his second year of government. Te information analyzed conveys little progress in decentralization and in the importance that players with veto powers were gaining within the ruling coalition.     

Protección de los recursos genéticos de los pueblos indígenas en los sistemas universal e interamericano de derechos humanos

This article shows the current state of protection of genetic resources of indigenous peoples in the context of international human rights. The analysis is justified because international law, regional and international on access to genetic resources of indigenous peoples is insufficient, poor and in some cases, nonexistent. The protection of genetic resources in relation to indigenous peoples has special connotations according to its own system of human rights of these peoples, so that it seeks to investigate whether international law of human rights takes into account these ethnic particularities. In this sense, a characterization of universal and inter-American system related to genetic resources in order to identify gaps and challenges of these systems.
