This paper examines some of the constitutional aspects of the ‘Future of Europe’ reform process in the light of interactions between German and ‘European’ federalism. Many aspects of the traditions of German federalism and German post-war constitutionalism have been influential, if not to say formative, for the evolution of the EU. These aspects are set out as a frame for the paper, before more detailed analysis of the constitutional process and a particular focus on the division of competences. The constitutional outcome reveals clear German ‘fingerprints’, though that finding needs to be balanced by a recognition of the constitutional debate as multi-perspectival, involving all member states both separately and collectively.  相似文献

The construction industry is the most male-dominated labour market in every country in Europe. In Britain and Denmark, women constitute only 1% of those employed in this industry. In spite of the barriers to women entering and remaining in skilled construction work, inroads have been made. Amongst housepainters in Denmark, for instance, women constitute 27% of the workforce and 40% of trainees, and in a number of local authorities' Direct Labour Organisations in Britain, relatively high proportions are to be found. Through the example of two women painters in Britain and Denmark, each with over 14 years' continuous employment, the authors identify the opportunities and obstacles to women entering and remaining in the construction industry. The commonalities and differences between the two countries are illustrated, and it is shown how integration has successfully occurred where social and working conditions are better. The paper concludes that gender segregation and the exclusion of women can be attributed to structural discrimination through training and recruitment mechanisms, the nature of labour relations, employment conditions and the wage system.  相似文献

Economical liberalization, market globalization and soy expansion stimulated the advance of big transnational companies in the Southern Cone countries (Brazil, Argentina, Paraguay and Uruguay). Currently, the main corporations acting on the last links of the productive chain are ADM (Archer Daniels Midland), Bunge, Cargill and Dreyfus (the ABCD firms), global leaders in the soy trade. The objective of this contribution is to analyze the different strategies these companies articulate in the Southern Cone, and their dynamics in local space through market relations with local producers. The results show the rapid and intense process of denationalization of the firms in the soy productive chain as well as the high level of market internationalization and company concentration. In spite of this, this study shows that all transnational power of ABCD firms, which seems so abstract and intimidating when seen in the global scale, depends on its basis of the formation, maintenance and exploration of relations of proximity, trust and reciprocity with local actors (especially rural producers), including family friendship linkages.  相似文献

The paper’s aim is to show to EU policy makers, academics, journalists and the general public what the available information tells us about crime levels, trends in crime and public opinion about crime among Member States. The paper centres on an analysis of current trends on crime levels and trends based on the data available both from victimisation surveys and police statistics. The victimisation survey source is the published data collected in the International Crime Victimisation Survey. A separate analysis based on the Eurobarometer was also carried out. Data on police statistics present two separate sources i.e. the Council of Europe Sourcebook and the crime data published annually by the UK Home Office. These two sources both add considerable value to the raw police statistics by their choice of data, their commentary and their technical explanations and definitions. The paper compares data on three crime types (robbery, domestic burglary and theft of a motor vehicle) across the 15 Member States of the European Union (as in 2003). These three types were selected in line with the priorities of the EU Commission and as types of crime that are a major concern for EU-citizens. The paper has been modified from a report produced by the European Crime prevention network for the EU Directorate of Justice and Home Affairs with the permission of the EU. Studies estimate that between three and ten million children in the United States witness domestic violence annually. Although studies have demonstrated a co‐occurrence of domestic violence and child abuse, there is no concrete evidence to support the assumption that a child's exposure to domestic violence increases the risk to the child of abuse or neglect. Recently the New York State Court of Appeals determined that a child's witness to abuse does not suffice, in and of itself, to show that removal of the child is necessary or that removal is in the “best interests” of the child. Programs which have developed alternatives to presumptive removal understand the importance of viewing the interests of the battered parent and children as being in accord with each other rather than in opposition. Private and government sponsored programs have demonstrated some success in protecting the parent‐child relationship, ensuring the safety of both parent and child, and increasing accountability of batterers while reducing the necessity for removals. Alternative programs are less costly to the state than foster care, and emotionally less costly to the families.  相似文献

Paradoxically, the greater the national security threats, the more important the role of local policy in the United States. In this article we examine homeland security initiatives—particularly the tension between risk and vulnerability—and the governance dilemmas they pose for local communities. In contrast to the usual emphasis on coordination and capacity, we argue for conceptualizing local imperatives attendant to homeland security as collective action problems requiring the construction of local performance regimes. Performance regimes must engage three challenges: (1) to enlist diverse stakeholders around a collective local security goal despite varying perceptions of its immediacy; (2) to persuade participants to sustain their involvement in the face of competing demands, and (3) to create a durable coalition around performance goals necessary for reducing local vulnerability. Using these analytic categories casts local homeland security issues in strategic terms; it also encourages comparisons of local governance arrangements to respond to risk and vulnerability.  相似文献
