论十六大以来党中央形成和提出的“三个总体布局“思想

党的十六大以来,以胡锦涛同志为总书记的党中央在理论创新和实践创新中,形成和提出了三个"总体布局"的战略思想,即"中国特色社会主义事业的总体布局"、"外事工作的总体布局"和"党的建设的总体布局"。这三个"总体布局"的思想,分别从内政、外交、党建的角度阐述了党在新时期新阶段的理论创新,表明了我们党对共产党执政规律、社会主义建设规律和人类社会发展规律的认识达到了一个新的高度。

This essay deals with the fast growing Sino-Latin American relations,touching upon the issues of the importance of Latin America to China;pros and cons of the bilateral relations;the U.S.factor;the opportunities that might be emerged from the financial crisis for the bilateral relations;China's first policy paper towards the region;the overseas Chinese contribution to the bilateral relations;Taiwan problem;the so-called neo-colonialism and the role of Europe.     

Windenergieanlagen und Freiraumschutz

Zusammenfassung  In Deutschland sind gegenw?rtig über 19.000 Windenergieanlagen installiert. Dies ist klimaschutz- und energiepolitisch zu Recht als Erfolg gewertet worden, hat aber auch erhebliche Konflikte mit dem Immissions-, Natur- und Landschaftsschutz hervorgebracht. Auf die Problemlage hat der Gesetzgeber insbesondere durch Schaffung verbesserter rechtlicher M?glichkeiten für eine r?umliche Konzentration von Windenergieanlagen reagiert. Durch verschiedene h?chstrichterliche Entscheidungen sind die rechtlichen Anforderungen an den Planungsvorbehalt des § 35 Abs. 3 S. 3 BauGB als Korrektiv der gesetzlichen Privilegierung der Errichtung von Windenergieanlagen (§ 35 Abs. 1 Nr. 5 BauGB) mittlerweile in hohem Ma?e pr?zisiert worden. Die M?glichkeiten, das Anliegen des Fl?chensparens auch in die Windenergieplanung zu integrieren, sind aber durch die gegenw?rtige Rechtsetzung noch nicht ausgesch?pft.     

Central Bank Independence in the EU: From Theory to Practice

Abstract:  This article provides an overview of the practical problems which arise in ensuring the effective independence of central banks in the EU, drawing on the European Central Bank's consultative experience. Four aspects of central bank independence are discussed separately: functional, institutional, personal and financial. The possible issues raised by central bank involvement in prudential supervision are touched upon. The main conclusion of the article is that a set of legal provisions is generally not sufficient to ensure proper central bank independence; a culture of respect for independence, including its limits, among all parties involved is essential.     

关于加强高校党外干部培训工作的思考

高校党外干部是我国干部队伍的重要来源之一,认真做好高校党外干部的培训工作在新形势下具有重要意义。高校党外干部培训要以培养"立场坚定、作风正派、素质过硬、全面发展"为目标,创新培训内容、形式和管理机制,不断提高干部思想政治素质、业务水平和解决问题的能力。     

商业银行服务收费法律问题浅析

自2003年<商业银行服务价格管理暂行办法>颁布以采,商业银行服务收费行为虽仍众说纷纭,但已经被大多数人所接受.本文从商业银行收费的法律依据、合理性等角度出发,分析了商业银行服务收费中存在的法律问题,以期对商业银行服务收费的维权提供一定的合理化建议及对策.     

侦查人员出庭作证的法律依据辨析

侦查人员出庭作证已列入我国新一轮司法改革方案之中,但理论界对侦查人员出庭作证的法律依据一直存在争论。有的认为《刑事诉讼法》第48条规定的证人包含了侦查人员,此条即为侦查人员出庭作证的法律依据;也有的认为《刑事诉讼法》第28条关于侦查人员应当回避的规定实际上否定了侦查人员出庭作证的资格。笔者对上述意见概不同意,认为在我国现行刑事诉讼法上侦查人员出庭作证是有依据的,只是不够直接、明确,应当根据侦查人员的法定职责、审判活动的实际需要、侦查人员及侦查工作的特殊性等因素完善侦查人员出庭作证的法律依据。     

20世纪末以来中、美与东盟的三边互动关系——以权力转移为视角

中国的崛起对美国和东盟均产生重大影响,导致中、美和东盟在经贸、政治和认知方面形成了互动关系。由于经济领域的区域经济一体化、贸易转移效应和政治领域东亚一体化的排斥效应等因素,中美在东亚的权力关系发生了转移,东亚秩序经历了结构性调整。三方在经贸、政治和认知的互动相互影响并呈正相关关系,使得东亚的权力转移在和平中实现。互动中仍存在一些问题需要三方调适和合作加以解决。     

巴基斯坦反恐态势及前景

巴基斯坦自”9·11”之后加入美国反恐阵线以来，其国内安全形势不仅未见好转，而且近年来恐怖势力愈加猖獗，暴力袭击事件频发，阿巴边境部落区”塔利班化”日益加剧，直接威胁巴政权体系的稳定。今年8月，巴政府军采取军事行动，使巴境内最大的恐怖主义头目贝图拉·马哈苏德毙命，但恐怖组织的实力并未受到太大削弱．孳生恐怖主义的社会、经济条件依然存在。巴未来反恐斗争仍任重道远。
