大国安全与地区发展的悖论?——基于冷战早期美拉关系的考察

为了遏制共产主义的发展,战后初期美国积极在西半球编织反共防务安全体系。与此相比,美国对拉美国家的经济援助需求消极怠慢,对它们所面临的经济发展问题视而不见,采取了“贸易而非援助”的经济政策,激化了美拉矛盾。20世纪五六十年代,一些拉美国家实行了国有化和土改等民族主义改革,并同苏联加强贸易往来,反美反独裁的游击运动风起云涌。在美国看来,这与其在西半球的经济安全和反共战略相悖。为了化解危机,美国一方面以反共和集体安全为名,对“敌对”政权进行军事干预,另一方面也在不断调整自身政策,加大对拉美国家的经济援助力度。不论怎样,谋求和巩固在西半球的霸主地位始终是美国制定拉美政策的根本目的,安全和稳定是其维护的主要利益。在理论上,只有拉美国家的深层经济发展问题得到有效解决,才能消除不稳定的隐患,所以,美国国家安全与拉美地区发展是并行不悖的。但在现实中,由于拉美国家的既得利益集团与美国关系密切,美国不可能切实推进拉美国家的经济改革,同时美国又常以安全防务政策化解由经济发展引发的拉美问题,这种立场上的偏差注定了美国提出的经济改革方案的“无效性”,而仅仅是一种权宜之计。     

论村民自治中的公民参与

村民自治是一种以参与为根本特征的民主治理形式,它对农村的基层民主和“两个文明”建设意义重大。有效参与是现代民主的核心内涵之一,村民参与村务管理的情况与实际效果,直接关系到他们对村民自治制度与实践的评价和投入。对村民自治中的公民参与现状的深入研究,将产生以点带面的“连锁效应”,为社会主义民主建设和社会主义制度的不断完善提供思路。     

A theory of executive dominance of congressional politics: the committee system in the Brazilian chamber of deputies

This article analyses the Brazilian Chamber of Deputies committee system using rational choice theories developed originally for the US Congress. We suggest that pure versions of these theories are unable to explain Brazilian committee politics, and point out the necessity of building a specific theory that takes into account key institutional characteristics which give the Brazilian Executive considerable power to control the legislative process to assure outcomes consistent with presidential preferences. We demonstrate that committees in Brazil operate to some degree as agents of the executive. For this reason, we call it the Theory of Executive Dominance.

伴随高等教育素质化要求,规范完善兼职大学生特殊群体劳动权益的重要性日益凸显.伴随着大学生越来越强的竞争意识,体验生活、积累经验的“打工”风潮在大学校园已经蔚然成风,但大学生“工资”受损现象越愈演愈烈,这与劳雇双方市场地位失衡、大学生屈居弱势,维权途径不畅、受害人诉求无门等原因有关,参考外国法对大学生兼职的保护规定,我们应该制定规范大学生校外兼职的相关法律法规,保护大学生权益.     

我国司法鉴定立法现状及展望

随着社会的发展和科技的进步,诉讼中遇到的专业性疑难问题越来越多,司法鉴定的重要性也日益受到人们的重视。由于我国目前缺少统一的司法鉴定立法,相关制度构建不够完善,以至于司法鉴定实践中法律规范缺位,秩序混乱,问题颇多,制约了司法鉴定活动的开展,也在不同层面上造成了不良的社会影响。本文着重对我国司法鉴定立法现状和立法变迁予以解读,深入剖析司法鉴定的现实困境,主张在立足现实的基础上寻求破解之道,从理论、实践、宏观、微观的多重角度对我国司法鉴定统一立法的可行性进行系统探讨,并在强调关注司法鉴定统一立法若干要素的基础上对我国未来的《司法鉴定法》予以展望。

2011年2月19日胡锦涛在省部级主要领导干部社会管理及其创新专题研讨班开班式上发表重要讲话，强调要加强和创新社会管理。社会管理离不开社会主义法治，社会主义法治理念的五要素是创新社会管理的前提和理由，社会主义法治理念的五要素更加符合创新社会管理的需要，为创新社会管理创造现实条件。先确立社会主义法治理念，再提创新社会管理，在逻辑上是顺理成章的事情。     

Understanding land ownership and environmental conservation from perspectives of enviro-capitalism and enviro-socialism

Enviro-capitalism and enviro-socialism address natural resource management and environmental conservation from the different perspectives regarding property rights, roles of free market and governments. The case studies of land ownership evolution in United States and P.R. China illustrate that mandatory administrative order from government failed in P.R. China, while the private owned land and managerial ways also cause the problems in the United States. The understanding about land values and functions changes over time. The concern is getting more and more focused on exploring the efficient ways to get land resources yielded perpetually, as well maintaining economic, social and political sustainability. We learn the lessons from the past. The land management depends on rationally identifying and measuring the roles of individual, mass and government in social-economic-ecological system by using the market dimensions and indexes. The case studies indicate that the owners of the land property will be able to engage in negotiated contracts with those seeking environmental protection through the free market. It also requires the governments to take the responsibilities to identify property rights and help build up the capacities to make the policies and laws based on the land ecosystem processing features, as well considering the cultural and economic status within the different spatial units. The governments should help to develop the enforcement technology for policy implementation at local, regional, national and international levels. The big challenge is that we lack knowledge and information to determine the processes and functions of social-economic-ecological system and measure the comprehensive values of land in large geographic units.
