Juvenile Shackling Reform: The Judicial Role in Ensuring Trauma‐Informed Courts and Why States Are Rethinking Restraints

In juvenile courts around the country, youth are routinely shackled, without any evidence that these young people are a danger to anyone or likely to attempt flight. A number of states are moving away from this practice. Shackling reform initiatives are motivated by constitutional issues, emerging science around adolescent development, and a growing recognition of the need for trauma‐informed, evidence‐based courts. Judges are ultimately responsible for safeguarding the rights of the young people who appear in court, and must uphold the dignity of the courtroom. A review of jurisdictions that have adopted limits on juvenile shackling shows that these policies have not resulted in breaches of safety.     

案外人异议之诉研究

2007年修改的民事诉讼法通过赋予案外人以提起诉讼的方式对执行行为可能侵犯其实体权益的情形予以救济,确立了案外人异议之诉的独立性,恢复了案外人异议的实体性本质。为了实现案外人异议之诉的价值,有必要在当事人、诉讼请求、管辖法院等诉讼构造以及当事人诉权的限制上实行与一般民事诉讼不相一致的独特制度。     

The Human Side of COVID‐19

The COVID‐19 pandemic has had, and continues to have, a broad, deep, and pervasive impact on our lives, our work, and how our justice system functions. While it is easy to contemplate the “system” as a massive behemoth that is impervious, impersonal, and impenetrable, the truth is that the “system” is made up of people. The men and women whose work is the building blocks of the justice system are individuals, each with their own narrative, experience, perspective, and role in the administration of justice. To understand the system and the impact of COVID‐19, it is essential to understand the stories of those who work in the system. This article presents the individual and human stories of four professionals whose professional lives are a part of the justice system. Each of these professionals tells their personal story of COVID‐19 and reflects on how the pandemic affected them and their approach to the work that they do.     

The Transitioning Families Therapeutic Reunification Model in Nonfamilial Abductions

The existing literature on abduction reunification is limited and evolving. Although guidelines for model service approaches exist, few programs address the unique challenges of reunifying children and families following abduction. This article delineates a family‐based reunification model that has assisted families affected by abduction since 2006. Model components include a team‐centered approach, a stage‐oriented reunification process, and pitfalls and strategies related to intersystem collaboration. We present the value of a family‐systems, solution‐focused, trauma‐informed, and case‐specific approach to therapeutic reunification following child abduction. Evidence that is contrary to the popular notion of Stockholm's syndrome is also marked. Research on the efficacy of therapeutic reunification is essential for the growth of systems equipped to address the dynamic needs of these families. Accordingly, suggestions for evaluation research are proposed.     

Motivating Juvenile Offenders Toward Making Responsible Choices in Daily Life

Based on the premise that the best deterrent to delinquent behavior is the offender's motivation to engage in moral reasoning and action, this article describes the value of teaching scientifically formulated principles of morality in the juvenile justice system. The authors review The Facts of Life Seminar, a program for teaching scientifically formulated principles of morality to delinquent youth. Outcome statistics demonstrate this approach is effective in providing incentives for adjudicated adolescents to refrain from theft and violence, to keep their promises, and to tell the truth.
