情事变更原则作为合同权利义务严重失衡的衡平机制,固然有其积极作用,却伴生权利可能被滥用的弊端.针对法院适用情事变更原则的民事裁判,必须构建高效的外部监督制衡机制,以防止合同权利及审判权力的滥用.目前学界均以情事变更原则的合理性为立论基点.以情事变更原则内生的法律风险为立论基点,以检察监督为载体,强化对法院的裁判监督制衡机制,以保障情事变更原则的正确施行.

我国超额外汇储备的影响及对策分析

近年来,我国外汇储备大幅度增长直接地反映了我国经济的快速发展。但持有过高外汇储备不仅机会成本过大,而且使我国货币政策的独立性削弱,通货膨胀的压力随之加剧。由于对冲策略的不可持续性,必须采取推进人民币汇率机制改革,转变出口导向的外贸战略,完善宏观政策调控手段,加强储备管理,增加实物资产储备等手段解决外汇储备过高的问题。
