The chief justice of the Australian Family Court discusses the use of mediation in the Family Court of Australia. He traces the legislative origin and the basic purposes of the service. Of particular interest is the differentiation between mediation, conciliation, and the court process. DEA is publishing a final rule regarding the registration and reregistration fees charged to controlled substances registrants. DEA is required to charge reasonable fees relating to the registration and control of the manufacture, distribution, and dispensing of controlled substances. To address this mandate, on March 22, 1993 DEA published a final rule in the Federal Register, establishing registration fees for controlled substances registrants (58 FR 15272). Following publication of the final rule, the American Medical Association (AMA) and others filed a complaint in the United States District Court for the District of Columbia objecting to the new fees. The district court issued its final order granting the government's motion for summary judgment and disposing of all claims. The AMA appealed. The United States Court of Appeals for the District of Columbia Circuit found DEA's rulemaking to be inadequate. The appeals court remanded, without vacating, the rule to DEA, requiring the agency to provide an opportunity for meaningful notice and comment on the fee-funded components of the Diversion Control Program. DEA responded to the remand requirement through a document published in the Federal Register on December 30, 1996 (61 FR 68624). This Final Rule supplements the December 30, 1996 Federal Register document and with that document, constitutes the final rule on the Drug Diversion Control Fee Account.  相似文献

The interaction between organizational superiors and their subordinates has a practical implication on the entire organizational life cycle in terms of ethical conduct. This study explores how ethics among public leadership could trickle down on the conduct of public employees by using two empirical cases from developing African countries context. Using the attraction–selection–attrition and social learning models, the study assesses how superiors influence street level bureaucrats' interaction with clients or customers. Drawing from existing cases and other secondary data, we propose a leadership‐ethical diffusion model that argues that subordinates' perception and experience of superiors' behavior tend to create a kind of organizational ‘ethical groupthink’, which spans the rank and file of the organization. The empirical status of Tom Tyler’s (1990) process-based model of regulation is frustrated by the fact that most studies are conducted in the US, leaving open the question of whether similar effects can be observed in countries with different historical and political contexts. The current study tests two process-based model hypotheses using cross-sectional survey data from 683 young adults in Slovenia. The results reveal: (1) procedural justice judgments significantly shape individual perceptions of police legitimacy, and (2) perceived police legitimacy explains self-reported compliance with the law. Though slightly diminished in magnitude, the legitimacy effect persists when using an instrumental variable to address possible endogeneity bias and after statistically controlling for known correlates of law violating behavior (i.e., personal morality and low self-control). The findings also show that the legitimacy effect on compliance with different laws (e.g., littering and buying stolen property) varies depending on the operationalization of legitimacy (i.e., additive scale versus instrumental variable). While the findings indicate that the process-based model of regulation is germane to post-socialist countries such as Slovenia, more research focusing on the explanatory breadth of the model is necessary.  相似文献
