Supervising junior doctors and "on-call" responsibilities: Brus v Australian Capital Territory; Greater Southern Area Health Service v Angus

The recent decisions of Brus v Australian Capital Territory [2007] ACTSC 83 and Greater Southern Area Health Service v Angus [2007] NSWSC 1211 highlight different aspects of the difficulties associated with supervision of junior doctors in the present public-funded Australian public hospital system. Their facts reveal how difficult it is for senior staff to achieve the fine balance required to assist trainees by according adequate experience and responsibility on the one hand, and to ensure patient safety, on the other. In addition, these cases highlight problems with the supervision process that are likely to be exacerbated in a privatised health care setting where senior staff may have less inclination to supervise struggling juniors unless adequately remunerated for such teaching, an issue of considerable controversy given the focus on profit of those institutions.     

Prevent Strategies: The Problems Associated in Defining Extremism: The Case of the United Kingdom

As the United Kingdom has placed some of its Prevent strategy on a statutory footing and is proposing to introduce a Counter-Extremism Bill, this article argues that a legal definition of extremism must be carefully drafted to provide legal certainty. The main recommendation is that all forms of violent and nonviolent extremism comes under the definition, ensuring it is differentiated from activism. Activism may hold radical views counter to the mainstream opinion, but it is required in liberal democracies as it encourages healthy debate and can prevent the policing of thought in any government strategy or legislation.     

Interpreting the Threshold Criteria under section 31(2) of the Children Act 1989 – the House of Lords decision in Re B1

Caregiving Responsibilities and Child Spanking

This study examines whether mothers who are also caregivers of elderly or dependent family members are more likely to resort to physical discipline than other mothers. Using data from the National Survey of Families and Households, we found that caregivers are more likely to spank their children than noncaregivers; however, among those who spank, caregivers are somewhat less prone to frequent spankings than noncaregivers. The data further suggest that it is primarily care for adults outside the household that is related to use and frequency of spankings.     

The Definition and Measurement of ‘Gang Status’: Policy Implications for Juvenile Justice

In this article, we examine gang membership and gang activity in Dona Ana County, New Mexico. We collected the data through a self-administered questionnaire completed by 373 randomly selected 9th and 11th grade students attending two high schools and two junior high schools. By the self-report method, 56 indicated they were currently active in a gang; another 45 had been members of gangs but were no longer involved; and, “wannabes,” or students who at some time had considered joining a gang but did not or could not, totaled 68. The 169 students who indicated some interest in or involvement with gangs represented 45% of the total sample. A more restrictive definition of actual gang membership (i.e., the group must have initiation rites and employ some external symbols of membership, such as “colors,” tattoos, or handsigns) results in a different trichotomization. We employ both the self-definition and restrictive definition of gang membership in our analysis of their personal biographical characteristics and criminal behavior. Our findings suggest that self-definition demonstrates clearer ties to self-reported gang-related activities than does the more restrictive one. We discuss the policy implications of this finding in the article.
