MAKING A PLACE AT THE TABLE:

This response to Timothy Tippins and Jeffrey Wittmann's article "Empirical and Ethical Problems with Custody Recommendations: A Call for Clinical Humility and Judicial Vigilance" builds upon the authors' conclusions that custody evaluations cannot and should not be a substitute for the socio-legal judgment of the best interests of the child. Recognizing that clinical humility and judicial vigilance may not be sufficient to restrain the misuse of psychological evaluation, we offer for consideration three structural changes that would provide for a more appropriate use of the skills and talents custody evaluators bring to legal decisions. We suggest using custody evaluators in the less adversarial setting of preparing parenting plans, revising the procedures by which custody evaluations are elicited in litigation, and adopting the approximation standard for child custody determinations.     

The National Nanotechnology Initiative and the Social Good

The purpose of the National Nanotechnology Initiative (NNI) is to promote nanotechnology in a way that benefits the citizens of the United States. It involves a commitment to support responsible development of nanotechnology. The NNI's enactment of this commitment is critically assessed. It is concluded that there are not adequate avenues within the NNI by which social and ethical issues can be raised, considered, and, when appropriate, addressed.     

Language Policy, Literacy, and Minority Languages

This paper surveys the development of language policy over the last 40 or more years, particularly with respect to linguistic minorities and the attendant problems of illiteracy and lack of access to basic education among these groups. While there are discernible, emerging trends in the area of language policy, we make considerable effort to point out that the evolution of such policy in the past has often been the product of an unpredictable confluence of national and international politics, economics (at all levels), social, cultural, and religious differences, intrigue, historical accident, human perversity, and serendipitous circumstances.     

Women Educators and Transnational Networking in the Twentieth-Century Nursery School Movement

In this article I argue that women educators' personal and professional networks underpinned the growth of nursery school education into a transnational movement in the interwar years. Edna Noble White, Lillian de Lissa, Mary Gutteridge and Gwendolyn Watkins' interlocking networks facilitated and connected the nursery school movements in the United Kingdom, United States, Canada and Australia. Although these women educators were at the centre of a feminised domain, I also show that their work and the movement were impacted by gender relations in the broader fields of education and child development research. Just as nursery school education transcended national boundaries and was reconfigured in each national context, so too the priorities and tensions in education and developmental psychology.     

Agrarian reform and the transition to socialism in Chile, 1970–1973

The purpose of this article is to examine Popular Unity's agrarian policy in the light of the failure of the revolutionary forces to capture power and initiate a transition to socialism in Chile. We argue that Popular Unity's agrarian policy reflects the limitations and contradictions of its strategy to power. Although Allende's agrarian reform was extensive, drastic and rapidly executed, it nevertheless limited the peasantry's contribution to the revolutionary struggle for power. In the first part we briefly examine the agrarian legacy left by the Christian Democrat government of Frei to the Popular Unity and present the agrarian programme of Allende's government. We proceed in the second part with an analysis of peasant mobilisation and organisation, focusing on land seizures and peasant councils. In the third part we devote our attention to the organisation and functioning of the expropriated latifundia, which constituted the reformed sector, and examine why socialist relations of production failed to develop. Finally, in the fourth part, we attempt an assessment of Popular Unity's agrarian policy from the viewpoint of the accumulation of revolutionary forces in the rural sector by highlighting some of its contradictions.     

Constitutional Chrononomy

Every constitution defines and is defined by a period in time. Like all law the creation and application of constitutions require reference to the past and future respectively. Every instance of constitution-making is an attempt to control behavior over an extended period of time. Therefore constitutions will be drafted, both in style and substance, to reflect that temporal ambition. The effectiveness of a constitution also requires that its interpretation makes reference to the understanding of its rules held by the constitution-makers. As a result, and notwithstanding the efforts to make it suitable over a long period by its creators, every constitution is bound to become unsuitable. Courts employ a number of devices to cope with the inevitable obsolescence of constitutions but, sooner or later, every constitution will have to be discarded and a new constitutional era begun.
