Design‐Build‐Finance‐Maintain‐Operate (DBFMO) contracts are a particular type of public‐private partnership whereby governments transfer the responsibility for the design, construction, financing, maintenance, and operation of a public infrastructure or utility service building to a multi‐headed private consortium through a long‐term performance contract. These arrangements present a typical principal‐agent problem because they incorporate a “carrot and stick” approach in which the agent (consortium) has to fulfill the expectations of the principal (procurer). This article deals with a neglected aspect in the literature related to the actual use of “the sticks or sanctions” in DBFMOs and assesses to what extent and under which conditions contract managers adopt a deterrence‐based enforcement approach or switch to a persuasion‐based approach, specifically when the contract clauses require the use of (automatic) deterrence. An empirical analysis of four DBFMOs in the Netherlands shows that the continuation of service delivery, the need to build trust, and the lack of agreement on output specifications play a role in the willingness of the procurer to apply a more responsive behavior that uses persuasion, even when deterrence should be automatically applied. © 2016 John Wiley & Sons Australia, Ltd 相似文献

This article examines the effects of the structure of intermunicipal cooperatives (IMCs) on the perceived transaction costs and benefits of IMCs. Hypotheses based on a polycentric theory of regional governance are tested using data from Dutch municipalities. The findings are mixed. In line with polycentric theory, networks characterized by a multiplicity of territorial scales reduce IMC transaction costs. Contrary to polycentric theory, however, if IMCs are organized under a uniform legal regime, lower costs and higher benefits are reported. Structural factors that dominate the debate between polycentrism and monocentrism prove to be of limited importance. On the other hand, the results indicate support for the hypotheses that intermunicipal trust (as a cultural variable) contributes to perceptions of effective and efficient cooperation. 相似文献

This paper is a response to the earlier paper by Lindsay, Mansour, Beaudry, Leach and Bertrand (2009). We argue that eyewitness research is an important public good and that high‐quality in research and policy formulations offered to the public interest is required to maintain our standing of trust. We argue that even though sequential lineups have been successfully codified in some jurisdictions as the exclusive eyewitness identification procedure, the claim of sequential superiority is built upon errors in the research process and that the evidence of reduced false identification with sequential lineups is completely offset by reductions in correct identifications. We reject the idea that the loss of correct identifications can be dismissed as guessing on the basis that this is speculative and that there is no published empirical support for the idea. We reject the idea that false identifications are necessarily more valuable for society to reduce than are correct identifications to achieve. Improvements in eyewitness identification are important, and interesting lines of investigation are available. It is questionable whether the sequential lineup is important among them. 相似文献

I address the functioning of the U.S. governing system by analyzing distributional outcomes from 1947 to 2000. The key question is whether public policy influences distributional outcomes. The macropolitics model and power resource theory suggest that left policies should equalize the distribution of income. I utilize single equation error correction models to assess the impact of policy on income inequality through two mechanisms—market conditioning and redistribution. Since nearly every government action influences markets in some way, I examine policy in the aggregate rather than focusing only on policies explicitly designed to redistribute income. The analysis indicates that policy influences inequality through both mechanisms, with left policy producing more equality. The results are consistent with power resource theory and strongly support the macropolitics model. Furthermore, I find that market conditioning is as important as, and works in tandem with, explicit redistribution. 相似文献

Despite extensive sociological research on gender and organizations, criminologists have paid insufficient attention to how organizational context and market demands may shape the extent and nature of women's participation in illicit enterprises. This study uses an organizational framework to examine the case of Chinese human smuggling to the United States. Drawing from interviews with 129 human smugglers, we propose a gendered market perspective for understanding the place of women in the human smuggling enterprise. We argue that the limited place of violence and turf as organizing features of human smuggling, the importance of interpersonal networks in defining and facilitating smuggling operations, gender ideologies about work and caregiving, and the impact of safety as an overriding concern for clients combine to create a more meaningful niche for women in human smuggling operations than is found in other criminal endeavors. Our research suggests that organizational and market contexts are significant explanations for gender stratification in illicit enterprises. 相似文献

The fact that war changes roles and responsibilities within society, while exposing men and women of all ages and classes to new threats and opportunities, has become increasingly recognised. Civil wars disrupt and destroy civilian life. Men leave, die in combat, are brutalised, lose employment, or resort to despair, violence, or apathy. Women assume enormous burdens of work and all manner of different tasks and responsibilities, lose their security and their protectors, and are victimised and marginalised. Yet few members of peacekeeping missions have any training in dealing with the civilian population, much less the specific issues relating to gender relations. In response to this, a basic training package titled Gender and Peace Support Operations has been designed for use in pre-deployment induction.
