The Texas death penalty statute originally approved by the United States Supreme Court in Jurek v. Texas (1976) was legislatively amended as a result of the Court’s decision in Penry v. Lynaugh (1989). The changes were intended to focus on increasing jurors’ ability to give mitigating effect to evidence in sentencing. Using data from the Capital Jury Project, we compared juror comprehension of sentencing guidelines, punishment responsibility, and deliberations in sentencing among a sample of 123 Texas jurors who deliberated under the Jurek and Penry statutes. In each area, we found that the amended statute failed to guide capital juror decision-making as intended. 相似文献

This case study explores the degree to which the number of court motions changed 1 year after parenting coordination was implemented with high-conflict co-parenting couples and examines the parents' demographic profile. Findings indicate a reduction of approximately 75% in child-related court filings, as well as a 40% decrease in other motions, resulting in a decrease of 50% in all motions filed, thus saving these once high-conflict couples, and the court, significant time and resources. The diverse demographic profile illuminates training and research implications regarding the use of parenting coordination as an intervention for high-conflict co-parenting couples. 相似文献

The paper contributes to the discussion about policy advice, initiated by Falk et al. in PVS 2/2007. Based on a differentiation between output- and input oriented politics, several notions of advice and knowledge are discussed. This leads to the insight that the relevance of studies in political science does rely on the careful consideration of the strategic influence of knowledge in the political process. The fruitfulness of such a perspective is exemplified by a short view on some institutional developments in the field of political advice. A detailed analysis of the newly organised economic policy report “Gemeinschaftsdiagnose” then reveals that the diagnosis of new cooperative modes of governmental acting, as postulated by Falk et al., has to be modified. In the 1990s, the Norwegian hospital sector was characterized by soft budgetary constraints and increasing budget deficits. This was one of the main antecedents of the 2002 hospital reform, where the central state took over ownership of the hospitals from the counties. Arguably, the centralization of ownership, financing and production would harden the budget constraints and increase the budgetary discipline. This analysis shows that this has not been accomplished. Instead, the production has been far above what was planned, and the deficits higher than ever. Two stages of the post-reform budget processes are analyzed: first, the stage where the central state set the budgets and sends signals of budgetary rules (whether the state sends signals of soft or hard budget constraints), and second, how the central state handled deficits in the hospital sector as they emerged (whether the hospitals was bailed out or not). The conclusion is that the central state neither set a hard budget constraint nor managed to stay firm as deficits turned up. It is argued that three mechanisms explain the prevailing problems of managing the hospital sector: uncertainty of the hospitals' financial situation during the transition phase; minority governments; and specific features related to the organization of the budgetary process in parliament. 相似文献

Elevators are mechanical transportation devices used to move vertically between different levels of a building. When first developed, elevators lacked the safety features. When safety mechanisms were developed, elevators became a common feature of multistory buildings. Despite their well-regarded safety record, elevators are not without the potential for danger of injury or death. Persons at-risk for elevator-related death include maintenance and construction workers, other employees, and those who are prone to risky behavior. Deaths may be related to asphyxia, blunt force, avulsion injuries, and various forms of environmental trauma. In this review, we report on 48 elevator-related deaths that occurred in nine different medicolegal death investigation jurisdictions within the United States over an approximately 30-year period. The data represents a cross-section of the different types of elevator-related deaths that may be encountered. The review also presents an overview of preventive strategies for the purpose of avoiding future elevator-related fatalities. 相似文献

We use 10 years of California administrative data with a regression kink design to estimate the causal impacts of benefits in the first state-level paid family leave program for women with earnings near the maximum benefit threshold. We find no evidence that a higher weekly benefit amount (WBA) increases leave duration or leads to adverse future labor market outcomes for this group. In contrast, we document that a rise in the WBA leads to an increased likelihood of returning to the pre-leave firm (conditional on any employment) and of making a subsequent paid family leave claim. 相似文献

Facing fragmented institutions and partisan polarization, officials in the United States often attempt to engineer policy change without assembling new legislative majorities. To this end, they have increasingly employed demonstration projects, policy innovations undertaken by administrative agencies designed to test alternative approaches to implementation or service delivery on a limited segment of the target population and for a limited period of time. Despite the increasing importance of demonstration projects, they are an undertheorized source of policy change. In this article, we conceptualize demonstration projects as part of a class of experimental institutions that, while incremental in scope, have the potential to ‘scale up’ into more substantial reforms. Data from three Medicare demonstrations suggest that policy change is more likely when programmes generate strong support constituencies; minimize administrative and infrastructural costs; are undertaken in contexts with few veto points; and align with the time horizons of elected officials. 相似文献

Planning and preparing for life after high school is a central developmental task of American adolescents, and may be even more critical for low-income youth who are less likely to attend a four year college. This study investigates factors that led to the effects of the New Hope Project, a work-based, anti-poverty program directed at parents on youths’ career-related thoughts and planning. The New Hope project was implemented in Milwaukee, WI, during the mid-1990s. 745 families participated (52 % male children; 56 % African American; 30 % Latino, and 15 % White non-Hispanic) and half were randomly selected to receive New Hope benefits, which included earnings supplements, job search assistance, and child and health care subsidies for 3 years. Importantly, effects on youths’ future orientation were found 8 years after the program began (5 years after benefits ended). The present study investigates what factors sustained these positive impacts over time. Results indicate that parental perceptions of reading performance mediate the effects of New Hope on youths’ cynicism about work. Additionally, parental perceptions of reading performance and youths’ educational expectations mediate the effects of New Hope on boys’ pessimism about future employment. These findings highlight the importance of youths’ educational development to their career-related thoughts and planning. 相似文献

The Abbott Government announced its White Paper review of the Australian Federation on June 28, 2014. Set against this backdrop, discussions of the future of Australian local government may provoke an assumption that its role will be cruelled. However, reflection suggests that such an assumption is misplaced. In particular, when the complexities of regionalism in Australia are considered, the potential role of local government begs revisiting.
