Terror in the Texts: Technology – Law – Future

This paper is concerned withlaw's failure and need to manifest theessentiality of technology for the West. Thiswill be shown through a critical reading of therelated fictional and juridical projects ofAmerican golden age science fiction and spacelaw. This analysis involves sensitivity to theterrors that bind together technology, law andthe future. It is argued that cornucopia, thevictory of modernism through technology, ispresented in science fiction and space law asterrorised by its other – dystopia. Thisterrorising means that cornucopia activelyresists dystopia. However, this resistiveenterprise is flawed – cornucopia never escapesdystopia. Alternative images of humanity andtechnology are needed to escape these flawedimaginings of the West. The paper concludesthat the cyborg offers the potential for aregenerative thinking about technology and law.     

Monitoring high-risk sex offenders with GPS

In response to media attention and public demand, legislation increasingly mandates more stringent surveillance for sex offenders. This trend towards greater supervision resulted in the lifetime GPS monitoring of high-risk sex offenders (HRSO) in California. This study assesses the impact of the California Department of Corrections and Rehabilitation’s GPS program for HRSOs by employing a quasi-experimental design. The treatment group was drawn from all HRSO who were released from prison and placed on GPS monitoring in California. To identify comparison individuals likely to have pretreatment risk characteristics similar to those in the treatment group, a propensity score matching procedure was performed. The final sample included 516 subjects equally divided between the treatment and control groups. Data was assessed using Cox proportional hazards survival analysis clustering participants by parole district. Results showed the GPS condition was associated with significantly fewer parole registration and arrest violations, arrests, and convictions. These results are discussed in relation to other electronic monitoring research, the policy implications for the increasing use of this technology, and its effectiveness in reducing crime, prison populations, and ensuring public safety.     

Therapeutic engagement in medium-secure care: an interpretative phenomenological analysis of service users’ experiences

Service users (SUs) detained in forensic hospitals are usually required to engage in psychological therapies aimed at reducing mental distress and/or for preventing further offending. Poor therapeutic engagement (TE) can lead to adverse clinical outcomes and reoffending, at a cost to the individual, staff, the service provider, and the public. To understand what factors influence TE from a SUs’ perspective, the experiences of 10 male residents of a medium-secure hospital were explored. Using a service-user informed design, interpretative phenomenological analysis of interview data was completed. Four superordinate themes emerged: different worlds; what the individual brings; what the therapy entails; and control. Consideration of how these factors may be of use to professionals working in secure care settings is discussed in relation to existing theory and research.     

The Prevalence of Paraphernalia Found at the Scene of Drug‐Related Deaths

Many illicit drugs involve the use of paraphernalia, and the presence of paraphernalia found at the scene of death may suggest that the death is drug‐related. Few sources of objective data are available regarding the prevalence of drug paraphernalia found at the scene of drug‐related deaths or the likelihood of a death with drug paraphernalia found at the scene to be drug‐related. This study reviews the deaths which were investigated by the Bexar County Medical Examiner's Office in an attempt to provide objective data. Over 4000 deaths with scene investigations were reviewed, and the presence of paraphernalia was found to be strongly associated with the death being drug‐related, heroin‐related, or cocaine‐related with the relative risk for each being 5.0, 15.4, and 6.6, respectively. This confirms that the presence of drug paraphernalia at the scene of death strongly suggests the death to be drug‐related and in particular heroin‐related.     

Seeing Law: The Comic,Icon and the Image in Law and Justice

This special issue examines how the comic and the icon prefigure forms of legality that are different to modern law. There is a primal seeing of law unmediated by reading, writing or possibly thinking. This introduction identifies the primacy of the eye, the emergence of visual jurisprudence and the transformations of law as a paper-based material practice to a digitally enabled activity.
