Expertise,Experience, and Ideology on Specialized Courts: The Case of the Court of Appeals for the Federal Circuit

What roles do prior expertise and accumulated experience play in shaping ideologically consistent voting on a specialized court? Using a dataset of obviousness patent cases from the Court of Appeals for the Federal Circuit spanning 1997–2007, we show that prior expertise enhances the influence of ideology on judicial decisionmaking, but that accumulated experience does not. In addition, we build on previous work and show that ideology is a factor in decisionmaking in technical areas of law, contrary to the received wisdom on patent cases.     

Negotiating Liberty: The Use of Political Opportunities and Civil Society by Barbary State Captives and Guantánamo Bay Detainees

This article contrasts two distinct sets of prisoners who were held by foreign governments: sailors from the United States held captive in Algiers in the late‐eighteenth century and British citizens detained in Guantánamo Bay in the early‐twenty‐first century. The article uses social movement theory to examine and compare the campaigns orchestrated by these men and their supporters, and the role of those campaigns in securing their freedom. It demonstrates the utility of social movement theory in comparing cases of foreign detention that transcend centuries, regions and communication technologies. We find that successful campaigns on behalf of citizens held captive abroad, and the timeline of those successes, are contingent on the exploitation of domestic political opportunities and an external event to trigger government action on behalf of the captives.     

Civilization: “It Means Just What I Choose It to Mean”

Civilization is a complex and powerful word and idea that should neither be reviled nor revered, but it should be respected. It is said that the idea of civilization can be used simply to describe; but as a binary term, the ideal of civilization can be used to both to describe and evaluate; or pass judgement in the very act of describing. The nature of such concepts is that they can be used to either commend or condemn the actions or peoples they are used to describe.     

Perceptions of Time and Their Impact on Negotiations in the Arabic-Speaking Islamic World

This article examines how perceptions of time affect Arabic-speaking Islamic negotiators and how their attitudes about time, and their corresponding behaviors, may differ from those of their Western counterparts. We begin by identifying cultural differences in the conceptualization of time and then comment on the role of time in negotiations, discussing how time influences bargaining, trust, and negotiation tactics. In the section on tactics, we discuss stall-and-delay tactics, the use of the past as an objective standard, and limits on negotiating the future. Our purpose is to encourage negotiators from the West to be knowledgeable about the way they, as well as negotiators from Arabic-speaking Islamic cultures, conceive of and use time in negotiations. We believe that understanding that the very concept of time is often quite different in these two cultures is an important step in facilitating negotiations that cross these cultural boundaries.     

Dudley Clarke’s official history of military deception, 1944–1945

This article analyses an episode in the development of intelligence official history in Britain. While an official history of intelligence in the Second World War was not approved until the 1970s, the idea had been pursued seriously in 1945 by Brigadier Dudley Clarke. Clarke had been the chief of deception operations in the Mediterranean theatre, and wanted to develop an official history and film recounting some of the exploits of his unit. This article argues that Clarke’s proposals, which were ultimately rejected by the Joint Intelligence Committee and the Chiefs of Staff, showed a prescient understanding of the power of official history, recognized that complete secrecy would be counter-productive, and are thus an important early milestone in the evolution of intelligence official history.     

Let's have more Russian babies. How anti-immigrant sentiment shapes family leave policy in Russia

This paper builds on scholarship of welfare chauvinism in Europe to present evidence of the relationship between xenophobia and family leave policies in contemporary Russia. I argue that popular anti-immigrant moods pressure government into providing more generous family benefits to Russian families while proposing restrictions to migrants. Findings are based on elite interviews, as well as content analysis of mass media, policy documents, public speeches, and party manifestos. I show that xenophobia is widespread in Russia among the public and policymakers alike, and find that xenophobia is embraced by policymakers to guide decisions regarding the allocation of social benefits.     

Interactions Between Rejection Sensitivity and Supportive Relationships in the Prediction of Adolescents’ Internalizing Difficulties

Rejection sensitivity, the tendency to anxiously or angrily expect rejection, is associated with internalizing difficulties during childhood and adolescence. The primary goal of the present study was to examine whether supportive parent–child relationships and friendships moderate associations that link angry and anxious rejection sensitivity to depression and social anxiety during middle adolescence in an ethnically diverse sample of 277 youth (M age = 14.30 years; 46.93% male). Analyses revealed that angry rejection sensitivity was related to depressive symptoms, but only for adolescents reporting low support from parents and friends. Friend support moderated the association between (1) angry rejection sensitivity and social anxiety, and (2) anxious rejection sensitivity and depressive symptoms. For adolescents reporting low support from friends, support from parents was positively related to social anxiety. Findings highlight the importance of considering relationships in studies of rejection sensitivity and adjustment during adolescence.
